Summary: Under California Vehicle Code Section 22350, in detrimental conditions like weather changes that could affect the maneuvering of a vehicle, it would be practical for drivers to decrease the speed of operation to guarantee everyone’s safety.

The basic prima facie limit is essentially a law outlining how drivers should safely drive on highways, in respect to environmental and infrastructure conditions.

Under California Vehicle Code Section 22350, in detrimental conditions like weather changes that could affect the maneuvering of a vehicle, it would be practical for drivers to decrease the speed of operation to guarantee everyone’s safety. A good example of this would be conditions of snow or rainfall. In addition, cases of fog or smoke, which can impair visibility, drivers should proceed at a slower pace. This would mean that drivers are taking preventative measures to avoid an accident.

When driving on a highway, speed limits should be adhered to. However, driving speeds should also be practical based on the roadway’s and visibility and surfaces.

If an official stops someone who has breached this code, the driver may receive a ticket for violating the basic speed law, with fines of three hundred and twenty eight dollars. Failure to pay the ticket may end in an infraction.

It is important to obey traffic laws, not only for everyone’s safety but for the benefit and driving rights of the drivers themselves. For instance, some violations can incur points and in doing so, if a sufficient amount is received on a  driving record in a selected period, the DMV office can revoke  driving rights temporarily. The length of time depends on the violations, instances and points incurred. Insurance companies may also raise their premium rates.

In many cases, drivers are innocent and as such, should contact a traffic law firm if they feel they’ve been incorrectly fined. Drivers will want to avoid any violations on their driving record as much as possible.
