Mr. Ross is a native Floridian, born and raised in Miami. After graduating from the University of Miami with a degree in Business Administration, he graduated from the University of Miami Law School in 1976. Since his admission to the Florida Bar in 1976, Mr. Ross has limited his practice exclusively to the defense of criminal matters in both State and Federal Courts. Mr. Ross has appeared in criminal courts throughout the country and has earned a national reputation as one of the pre-eminent criminal defense lawyers. His reputation became national in scope with the stunning acquittal of Oscar Rivera Nuñez who was alleged to have been the source of cocaine in Bolivia to what was then alleged to have been one of the largest cocaine smuggling organizations in the United States. His performance in United States v. Oscar Rivera Nunez is documented in Coming Clean, the Story of a Cocaine Drug Lord by Jorge Valdes (Waterbrook Press, 1999). Mr. Ross is described therein by the author: "Alan was a pro; he was the best of the best.. " Mr. Ross built upon his quickly established and national reputation as one of the best through a long list of acquittals in major federal drug cases throughout the United States. Some of the more memorable cases include the acquittal of all Defendants in what popularly became known as the "Bubba Bust" case in Key West, Florida. The Bubba Bust case was memorable, not only because of its result, but because Mr. Ross had the government's star witness arrested on the witness stand for a crime that the witness had concealed from the government. No less memorable is the acquittal of Police Captain Robert Liuzo who was alleged to have received bribes and provided protection for a drug organization in Ft. Lauderdale, Florida. Mr. Ross' reputation, however, was not built solely on the defense of drug cases. The acquittal of his client, Farhin Sanai in the United States Government's misdirected prosecution popularly known as "Iranscam", was a highly publicized and now, infamous case in U.S. History. Mr. Ross' investigation and successful defense in Iranscam resulted in his being invited by the United States House of Representatives Committee on the Judiciary to testify regarding FBI undercover operations before the Sub-Committee on Civil and Constitutional Rights. Mr. Ross is a frequent lecturer and invited speaker at seminars sponsored by both National and State Criminal Defense Associations. Mr. Ross is a Life Member of the National Association of Criminal Lawyers and a member of the Florida Association of Criminal Lawyers.

Please describe a case in the last year or two where you made a big difference.

I recently enjoyed having made a huge difference in the life of a client. My client was a 17 year old high school student who was charged as an adult with DUI Manslaughter and facing 11 to 15 years in prison if convicted. The FHP trooper who was the traffic homicide investigator claimed that, although there was no observation of anything suggesting my client was impaired or intoxicated, she consented to a blood draw. In fact she had indeed signed a written consent and submitted to a blood draw that revealed both alcohol and drugs. Using the meta-tags on the photos taken at the accident scene to impeach the Trooper's recollection of when my client "consented" to the blood draw, I was able to persuade the Court that the consent was involuntary because obtained after the client was told that blood draws are mandatory in all cases resulting in a death and that she, therefore, had no alternative. The Motion to Suppress the blood was granted and the State subsequently announced a dismissal of the charges. My client is attending college and working towards her degree. Her parents were most thankful for my changing their daughter's life.

How did you build a successful practice?

I have built my practice over the past 37 years based on solid results for many many clients. While many clients come to me based on the recommendation of a friend or acquaintance, about half of my cases are referred by Civil Lawyers who are looking to refer a client with a criminal problem or issue. Former clients who are well satisfied with my zealous representation have given me a reputation in the legal community for hard work and creativity. My current clients are happy because I am responsive to their needs. I can be reached 24 hours a day and I always return client's phone calls. I have also surrounded myself with brilliant and talented law partners and an excellent support staff which has contributed substantially to the continued success of our firm which we established in 1977. By focusing only on criminal law we believe we can do a better job than those who practice in multiple areas.

What should clients look for in a lawyer?

When looking for a lawyer, the client should first research the biography of the lawyer to learn what experience the lawyer has had with cases like the one the client has. Hiring a lawyer who has experience handling divorces hardly qualifies that lawyer to handle a murder case or other serious criminal case. Our firm, as an example, handles only criminal cases and that is all that we have done for 36 years. Clients should look for specialization and experience in the criminal law field. Clients should also look at the lawyer's track record to see if the lawyer has been successful before on cases just like that of the client. You will want to hire a lawyer you can trust and who is accessible and will keep you advised as your case progresses. Clients should also look for a lawyer with a great reputation, both with other criminal defense lawyers but also with Judges and Prosecutors. The ability to maneuver through the complexities of the criminal courts is something learned from experience and through relationships that are created over many years of practice, so these too are things a client should look for when hiring a criminal defense lawyer.

  • Mr. Ross was admitted to the Supreme Court of Florida in 1976 and subsequently to the United States Supreme Court in 1979. He is a member of United States Court of Appeals for the Third, Fourth, Fifth, Sixth, Eighth, Ninth and Eleventh Circuits. He has been admitted to the United States Tax Court since 1978. He is a member of the Trial Bar of the United States District Court for the Southern District of Florida and is also admitted to the United States District Court for the Northern District of Florida, the United States District Court for the Middle District of Florida and the United States District Court for the District of Wisconsin.

The stunning "not guilty" verdict in the first degree murder prosecution of Michael Weaver is but one of numerous acquittals that Mr. Ross has obtained in the most serious of cases prosecuted in the State Courts of Florida. His vast experience and expertise in the defense of homicide cases was showcased in State of Florida v. Joyce Cohen, and was subsequently documented in the book written about the case; In the Fast Lane by Carol Cope (Simon & Schuster, 1993). His legal work in the Cohen case has also been documented in numerous national television programs including, Court TV, 48 hours, City Confidential, Hard Copy, CBS Evening News, and other major network news magazines. The video footage of Mr. Ross' cross-examination of the medical examiner in the Cohen case continues to be used by medical examiners' offices as a training film to prepare forensic pathologists for expert and rigorous cross-examination. Noted and nationally recognized forensic pathologist, Dr. Michael Baden, the former Chief Medical Examiner of New York, wrote that "Ross' knowledge and use of the science of pathology is impressive.." Dr. Baden referred to Ross as the "Clarence Darrow of criminal defense attorneys." Mr. Ross has also been a leader among criminal defense attorneys in addressing the overzealousness of prosecutors and government agents in federal drug investigations. The government's misdirected and ill-conceived efforts to violate his client's constitutionally protected right to effective counsel resulted in a dismissal of the government.s case in United States v. Rosenthal. His work in that case was documented as an example of the government's overreaching in their war on drugs in Steven Wisotsky's book Breaking the Impasse in the War on Drugs.
