De Leon v. Bank of America, N.A., 2009 WL 3822392 Practice Area: Class Action Outcome: Bank's motion to dismiss was denied, and the case moved forward and eventually settled. Description: This was a class-action lawsuit against a credit-card issuer for breach of contract for failing to credit customers' payments "upon receipt" as provided for in the credit-card terms and conditions. The bank moved to dismiss the Complaint, alleging that the relationship between the cardholder and the bank was governed instead by the monthly billing statement, which contained a different clause about when payments would be credited. In the cardholder's response to the motion to dismiss, I successfully argued that the monthly statement was not part of the agreement, and the case was able to move forward. Toyota of Orlando, 2009 WL 1075991 Practice Area: Litigation Outcome: Dealership's motion to compel arbitration was denied, and the case moved forward in federal court. Eventually resulted in confidential settlement.. Description: My client sued her former employer, a car dealership, for unpaid wages and other causes of action. The dealership argued that my client had signed an "Arbitration Agreement" when she was first hired and therefore was unable to sue in federal court. I successfully argued that the arbitration agreement was invalid as to my client, and the case was able to move forward. Marietta Practice Area: Copyright Infringement Outcome: Dismissed on behalf of my client Description: Copyright infringement case. My client was sued for allegedly exerting ownership control over photographs. Does 1-21, 3:12-cv-00575 (M.D. Fla.) Practice Area: Copyright Infringement Outcome: The case was severed, and the claims against my client, as well as other John Does, were dismissed Description: This was one of many copyright infringement cases filed for alleged downloading of movies against mass numbers of unidentified "John Does." I represented one of several John Does who had moved to have the case severed and the claims against my client dismissed. Malibu Media v. John Does 1-24, 2:12–cv–425 (M.D. Fla.) Practice Area: Copyright Infringement Outcome: At first, the Court denied the motion to sever, but, after I filed a motion for reconsideration, the Court reconsidered its prior order and agreed to sever the case, dismissing the claims against all but one of the John Does. Description: This was another one of several cases filed against large numbers of anonymous John Does for allegedly downloading films via the BitTorrent protocol and infringing a copyright. On behalf of my client, an anonymous John Doe, I asked Court to sever the case and dismiss the claims against my client. Hernandez v. Avalon Group Southeast Practice Area: Employment & Labor Outcome: Settlement Description: This was a federal wage-and-hour case (Fair Labor Standards Act) where my clients had worked as painters without payment. Bait Prods. Pty Ltd. v. Does 1-71, No. 8:12-CV-2465-T-30TGW, 2013 WL 23904 Practice Area: Copyright Infringement Outcome: Severed Description: Film company Bait Productions filed a lawsuit against 71 John Does for copyright infringement via BitTorrent downloading. On behalf of one of the John Does, I filed a Motion to Sever Defendants. The Court severed the case, dismissing claims against 70 of the John Does. Celestial, Inc. v. John Does 1-252, No. 2:12-CV-82-FTM-99DNF, 2012 WL 5058460 Practice Area: Copyright Infringement Outcome: Subpoena Quashed Description: I represented several John Does in this case, which was filed against 252 John Does for copyright infringement of alleged downloading of films via the BitTorrent protocol. I filed motions to quash subpoenas to Internet Service Provider with the goal of protecting my clients' identities from the Plaintiff. Canal Street Films v. Comcast Cable Communications, LLC Practice Area: Copyright Infringement Outcome: The Plaintiff agreed to vacate the judgment, and the case was dismissed Description: This was a lawsuit filed by Canal Street Films in state court (Brevard County) against Internet Service Providers using the ancient equitable remedy known as the Florida “bill of discovery.” Somehow the Plaintiff obtained a final judgment and notice was served on Internet accountholders, including my clients, that they needed to intervene or else the ISPs would release their information. I filed a motion to vacate the judgment and enter a protective order, arguing that the Plaintiff, Canal Films, had misused the bill of discovery process. I argued that the state court lacked subject-matter jurisdiction to hear the case, as federal courts have exclusive jurisdiction over copyright claims. I also argued that, by not including the John Does as Defendants, Plaintiff had obtained a judgment against the allegedly guilty parties without notice, which was a violation of their due process rights. Shea v. Demings et al., 6:11-cv-01677-JA-DAB Practice Area: Civil Rights Outcome: Settlement Description: My client was arrested because her name was similar (but not the same) to a woman who was wanted under a warrant. I helped her to file a lawsuit against the Orange County Sheriff's Office. Midland Finding LLC v. Costa, 2011-CC-001846-O Practice Area: Litigation Outcome: Dismissed Description: My client was sued for the alleged non-payment of a credit-card debt. I filed a motion to dismiss, arguing that bill-collector Plaintiff had failed to establish standing to collect on the account in question. I also argued that the Plaintiff had failed to state a cause of action. Edson Segundo General Contractor Inc. v. McCarthy et al., 2011-CA-013503-O Practice Area: Litigation Outcome: Settlement Description: I represented General Contractors who had not been paid for their work. We filed a lawsuit against the building owner, and the case quickly settled. Nu Image, Inc. v. Does 1-3932, Case No. 2:12-cv-00545 (M.D. Fla.) Practice Area: Copyright Infringement Outcome: Subpoenas quashed, case severed, eventually dismissed Description: I represented John Does in a federal copyright infringement case that had been filed against 3,932 separate John Does. I filed a motion to quash subpoenas to protect my client's identifying information from being released, along with a motion to sever the case. Patrick Collins, Inc. v. Does 1-8, No. 3:12-cv-00334-TJC-JBT Practice Area: Copyright Infringement Outcome: Subpoena quashed, case dismissed Description: This was a copyright-infringement case filed against by multiple defendants for the alleged download of films via the BitTorrent protocol. I filed a motion to quash and dismiss, as well as memoranda and notices of supplemental authority. The plaintiff eventually filed a notice of voluntary dismissal, and the court dismissed the case. My client's contact information was never revealed.
