Professional Liability Insurance: Not required to report Discipline Date: 05/16/1978 Discipline Activity: Censure Discipline Detail: IT WAS THE FINDING OF THE LOCAL ADMINISTRATIVE COMMITTEE THAT IRVAL L. MORTENSEN, ATTORNEY, RECEIVED MONEY FROM A COMPANY TO BE HELD IN ESCROW PENDING THE NEGOTIATIONS AND FINALIZATION OF A PROPERTY PURCHASE AGREEMENT. THE ATTORNEY DEPOSITED SAID MONEY IN THE LAW FIRM TRUST ACCOUNT. PRIOR TO OR DURING THE SAME TIME, THE ATTORNEY REPRESENTED THE COMPANY IN UNRELATED MATTERS. SUBSEQUENTLY, THE COMPANY AND A REALTOR ENTERED INTO NEGOTIATIONS REGARDING THE PURCHASE OF CERTAIN REAL ESTATE IN SAFFORD, ARIZONA. DURING THE COURSE OF THE NEGOTIATIONS, DOCUMENTS WERE PREPARED BY THE ATTORNEY AT THE REQUEST OF THE REALTOR AND FORWARDED TO THE COMPANY FOR APPROVAL. THROUGHOUT THE COURSE OF THESE DEALINGS, THE LAW FIRM REPRSENTED THE REALTOR ALSO AND HAD REPRESENTED HIM FOR SOME TIME PREVIOUSLY.THE COMPANY NOTIFIED MORTENSEN THAT IT DESIRED TO DISCONTINUE NEGOTIATIONS REGARDING THE REAL ESTATE AS NO AGREEMENT HAD BEEN REACHED. THE COMPANY REQUESTED THE RETURN OF THE FUNDS HELD IN THE ATTORNEY'S TRUST ACCOUNT. THE ATTORNEY REFUSED TO RETURN SAID FUNDS AND INITIALLY INDICATED HE WOULD DO NOTHING WITH THE FUNDS UNTIL THE COMPANY AND THE REALTOR RESOLVED THEIR DIFFERENCES. THEREAFTER, DEMANDS WERE MADE BY BOTH THE REALTOR AND THE COMPANY TO PAY THE FUNDS TO THEM.
