State v. Guinn Domestic Abuse Assault Causing Injury, Greene County Victim testified regarding assault. In her testimony, the alleged victim claimed the defendant attempted to run over her with his car, knocking her against the house and rendering her unconscious. Following presentation of the testimony and physical evidence, the jury returned a verdict of not guilty. State v. Flores First Degree Murder, Polk County Mr. Nelsen assisted in the representation of David Flores after he was granted a new trial following a 1996 conviction for First Degree Murder and having been sentenced to a term of life without parole. The State alleged that Flores was involved in the 1996 shooting death of Phyllis Davis, a Des Moines bank executive, who was driving home from work when she was caught in the cross fire of what was described as a rolling gun battle between various vehicles. A new trial was granted when previously undisclosed evidence arose suggesting a different perpetrator was in the offense. Mr. Neslen worked with Robert Montgomery and Brandon Brown on the newly opened case, and their efforts resulted in Mr. Flores being released from prison in 2013. State v. Eighmy Possession of a Controlled Substance, Carroll County Client was charged with possession of a controlled substance following the execution of a search warrant. Following depositions, and discovery requests regarding information from officers not listed as witnesses, but whom had information and background regarding the search warrant, the State agreed to dismiss the charge.
