At the time of his arrest, Mr. Hegberg admitted misappropriating client funds in order to use them for gambling. On January 24, 2001, Mr. Hegberg was charged with two felony counts misappropriating funds in excess of 0,000.00 and fraudulently drawing checks for which insufficient funds existed in the amount of approximately 0,000.00. Mr. Hegberg failed to cooperate with the State Bar in its investigation of these allegations.In Count Two, a client retained Mr. Hegberg to represent her in a dissolution matter on April 26, 2000, By stipulation, the clients husband agreed to pay her ,000.00 as settlement of all the property issues. On July 6, 2000, Mr. Hegberg received a cashiers check in the amount of ,000.00. Mr. Hegberg received a second cashiers check in the amount of ,000.00 a few days later. Both checks were made out to Mr. Hegberg. On July 28, 2000, Mr. Hegberg gave a trust account check for ,000.00 to his client, but the check was returned for insufficient funds. On July 12, 2000, the client discovered from her ex-husband that the two checks had been delivered to Mr. Hegberg. The ex-husband told the client that he had been instructed by Mr. Hegberg to make the cashier¡¯s checks payable to Mr. Hegberg. The client made repeated attempts to contact Mr. Hegberg but was unsuccessful and so the client reported Mr. Hegberg to the police who took Mr. Hegberg to the police station where he confessed the misappropriation of funds. Mr. Hegberg failed to cooperate with the State Bar in its investigation of these allegations.In Count Three, in March 2000 a client retained Mr. Hegberg for a matter involving an assignment of rents relating to property owned by his now-de"ased mother. Upon the mother¡¯s death, the renter had ceased making rental payments. The client paid Mr. Hegberg a retainer of 0.00.
