• THE ISSUE OF "DILUTION" IN THE AREA OF TRADEMARKS
  
  Dilution occurs when a company uses a mark that is similar to one that is famous and this causes injury to the reputation of the owner of the trademark. Generally speaking a company obtains a trademark to brand a business and establish a certain identity in the marketplace. Dilution is the unathorized use of an existing mark that is owned by one party to further the business of another party.
  
  In order to bring a trademark infringement action against someone on the basis of dilution, the trademark owner must prove that their mark is famous and distinctive and that another company used a similar mark and this caused "dilution" in the market. This means that the other company’s use of a similar mark harmed the value of the famous mark.
  
  This harm will likely be demonstrated when a customer is led to believe that they are purchasing a good from the owner of the "famous" mark when in reality it is a good from the other party. In other words the use of the similar mark confused the consumer and also may likely tarnish the goodwill of the owner of the original mark by selling a product that did not live up to the high standards of the owner of the "famous" mark.
