Having been a seasoned trial attorney since 1981, Mr. Yampolsky has tried virtually every type of serious criminal matter, including numerous murder cases. Some of Mr. Yampolsky's many successes include: obtaining three murder acquittals; a dismissal of a capital murder case on a procedural issue; an acquittal in the nationally recognized "Computer Gang" case; and successfully arguing before the United States Supreme Court in Nevada v. Riggins (1992), a death penalty case. Mr. Yampolsky is AV rated by Martindale-Hubbell, the highest rating available to any attorney. This rating is obtained by an independent rating of lawyers and judges who are familiar with his representation of clients. Less than 7% of all law firms in the United States are accorded this honor. Mr. Yampolsky is past President of the Nevada Attorneys for Criminal Justice. Mr. Yampolsky graduated from Boston University in 1976 and the University of San Diego School of Law in 1980. He was admitted to California State Bar in 1981, admitted to Massachusetts State Bar in 1982 (currently inactive), admitted to Nevada State Bar in October of 1984, admitted to Colorado State Bar in 1994, and admitted to Washington D.C. State Bar in 1999.

Please describe a case in the last year or two where you made a big difference.

I represented an Iraqi War veteran with PTSD . He was charged with assault with a deadly weapon (ADW) and felony malicious injury to property. About 50 Swat members stormed his house, broke his windows, threw tear gas and sent in bomb sniffing robots. He had a flashback and freaked out. The DA wanted him to plead to a felony. I was ready to take the case to trial with a self defense theory because of the robots. Due to his condition he was in reasonable fear for his life or substantial bodily harm. Then I said I would call the press. After that conversation he pled guilty to a couple of misdemeanor disorderly conduct charges so he got probation and did not lose his medical benefits

How did you build a successful practice?

I worked hard and returned phone calls right away. I attended many seminars all over the county teaching me how to be a better lawyer and many people including attorneys began to refer my business.

What should clients look for in a lawyer?

Someone who is experienced in their type of case, smart and not afraid to go to trial. Also a lawyer who communicates well and responds to their questions quickly.

How important is local knowledge to the success of your cases?

Extremely important, certain judges and DA's develop behavior patterns that factor into decisions how to best handle cases.

What information can you provide in a free phone consultation?

Information regarding their case, ways to defend it, and likely outcomes. Pros and cons of pleading guilty or going to trial.

What information do you need in a free phone consultation?

Case synopsis and any paperwork such as charging documents, police reports, witness statements, etc, if they have them

What differentiates you from other lawyers in your community?

I've been practicing over 34 years, I've won a case in front of the U.S. Supreme Court (Riggins vs Nevada), and I've won several murder cases. I am certified as a criminal specialist by the Nevada State bar.

What is the most rewarding aspect of your job?

Helping people and getting a great result when they thought there was no hope, keeping them out of jail, getting their case dismissed.

What are your other interests in addition to law?

I play the piano and I often perform at legal events, fundraisers, campaign parties, etc. I've written a musical about law school, called the Writs of Spring

Las Vegas' Adverse Possession Law
Adverse possession is the legal concept that if the owner of the land isn’t using it, and someone else is giving the land a useful purpose for long enough, the law favors the useful purpose over the land being left unused.
