Attorney Mark A. Buterbaugh manages and handles all of the firm’s workers’ compensation cases. He has recovered millions of dollars in benefits for injured workers.  He has a full workers’ compensation practice, from filing claim petitions for benefits, to defending against employer petitions, to fighting over description of injury and appropriate medical treatment, to negotiating fair and reasonable lump sum settlements.  He also handles Federal Workers Compensation cases, assisting Federal government employees obtain and protect the benefits they are entitled to under the Federal Employees Compensation Act.  Attorney Buterbaugh also has a full Social Security Disability practice, representing persons who are denied social security disability benefits throughout Pennsylvania and Maryland.

Immediately prior to joining Mooney & Associates, Attorney Buterbaugh worked for a large Pennsylvania law firm representing some of Pennsylvania’s largest Employers and Insurance Carriers in workers’ compensation defense. His experience on the defense side provided valuable insight, experience, and knowledge as to the strategies and the way insurance defense attorneys approach workers’ compensation cases. It also provided him a broad foundation into medical records review and medical knowledge of various injuries, which is critical to understanding a workers’ compensation case.

Attorney Buterbaugh graduated from Widener University School of Law in 2009. He also holds a Bachelor’s Degree from Penn State (1992) and a Masters Degree from Shippensburg University (1997). After law school, Attorney Buterbaugh served as an Enforcement Counsel for the Pennsylvania Gaming Control Board, helping to enforce the laws and regulations within the Pennsylvania casino and gaming industry. Prior to that position, he served fourteen years in various staff positions with the Pennsylvania House of Representatives.

Attorney Buterbaugh resides in Shippensburg, Pennsylvania and has served on various community boards. He was the youngest elected President of Borough Council in Shippensburg history at the age of 24 (1996). Attorney Buterbaugh was elected to the Shippensburg School Board in 2013 and currently serves as President of the School Board.
Please describe a case in the last year or two where you made a big difference.

I represent clients in workers compensation, from watching over and reviewing cases, to negotiating and settling case for a lump sum settlement, to full litigation. We make a difference in all of our cases.

How did you build a successful practice?

Few things. First, my business has thrived on referrals from previous clients. That happens because we ensure we do two very important things in representing my clients. First, you must understand your clients expectations and reconcile that with a discussion on reasonable expectations. Clients don't like promises that can't be kept. Clients don't want an attorney to just tell them what they want to hear. I pride myself on being up front and honest with my clients. Second, it all goes back to effective communication. I have gained many new clients that were previously represented by other counsel, but they were displeased by the lack of returned phone calls or communication. Not at Mooney & Associates. I pride myself on communication. My clients are hurt. They are frustrated. They are apprehensive. Communication helps relieve that anxiety.

What should clients look for in a lawyer?

A Lawyer that isn't just going to tell them what they want to hear and promise them a big recovery before even discussing the facts of the case. Clients should seek a Lawyer that listens, explains, and provides honest answer to difficult questions.

How important is local knowledge to the success of your cases?

A client should always seek a workers compensation attorney that practice in workers compensation every day. It is a complex litigation process that is heavily dependent on medical knowledge and terminology. Insurance company attorneys are experienced and know the workers compensation process. Your lawyer should too.

What information can you provide in a free phone consultation?

An honest case evaluation and advice on how to move forward. There should be a level of setting expectations and understanding the most important thing of all - the client's main concerns.

What information do you need in a free phone consultation?

When injury occurred, the employer, what was injured, work status and did it occur in Pennsylvania.

What differentiates you from other lawyers in your community?

We listen to expectations, we discuss those expectations, but most importantly it isn't just about signing the fee agreement. It is about understanding the clients main concerns. Why are they really calling an attorney. What are the main concerns. Understanding that helps create effective representation. Second, my client will know right away that I am not just here to settle their case, like may law firms. Settlement may not be right for the client because of medical needs, outstanding bills, severity of injury, and more. An honest settlement discussion will go well beyond numbers, but also whether it is right for the injured worker. That is the key. It should never be just about the fee. It should be about the injured worker and protecting their rights, benefits, and futures.

What is the most rewarding aspect of your job?

This is easy. When a client says Thank you and I appreciate everything you have done for me.

Are you involved in your community?

Recently served 10 years as an elected official on a local school board, currently serve on the Board of a Food Bank, serve on a Board of a county United Way, and serve on two committees, the Bylaws Committee and the Outreach Committee of the Pennsylvania State Bar Association.
