Svejda 14300 N. Northsight Blvd. Ste 224, Scottsdale, was suspended for six months effective January 1, 2011. He was also placed on probation for one year or until he completes the continuinglegal-education video program The Ten Deadly Sins of Conflict, whichever is earlier. Mr. Svejda was also assessed the costs and expense of the disciplinary proceeding. Mr. Svejda was negligently involved in preparing a will for a German citizen, Mr. Kell, while Mr. Svejda was a contingent beneficiary and Mr. Svejdas wife was a beneficiary, in violation of ER 1.8 (c). After Mr. Kell died, Mr. Svejda had an actual or potential conflict of interest that he failed to explain adequately to Mrs. Kell while acting as personal representative of the Kell estate. The conflict resulted because he also represented a company named TDI in which Mr. Svejdas wife became a 40 percent shareholder and which was the general partner in several limited partnerships in which Mr. Kell and later the estate was the limited partner while Respondent was a contingent beneficiary and his wife was a beneficiary of the Kell estate, in violation of ERs 1.7(a)(1) and 8.4(d). Mr. Svejda also failed to explain fully his actual or potential conflict or to obtain a conflict of interest waiver in violation of ER1.7 (b). Mr. Svejda negligently failed to notify Mrs. Kell, her attorneys, or the estate¡¯s attorney of the sale of the real estate underlying a limited partnership or the investment of the sale proceeds in a mortgage company and negligently failed to initiate the dissolution of the partnership on behalf of the general partner TDI in violation of ER 1.7(a), 1.7(b) and 8.4(d). Mr. Svejda also failed to notify Mrs. Kell or her attorneys the estate¡¯s attorney, the subsequent personal representative or his counsel, or the Probate Court about the sale of the real estate underlying an additional limited partnership , and knowingly failed to seek clarification of the court¡¯s order restricting the assets, and also negligently failed to notify the above-mentioned individuals about the investment of the proceeds of the sale in the mortgage company and negligently did not initiate the dissolution of the partnership on behalf of the general partner TDI -- all of whi"ed to extensive litigation and resulted in a violation of ER 8.4(d) and Rule 53(c). No restitution was ordered as Mr. Svejda a substantial amount of money jointly with his wife to settle a probate lawsuit filed by Mrs. Kell.
