DWI Charges Reduced to Careless Driving and License Revocation Avoided Mike Brandt’s client, a college student in the State of Iowa, was in Minnesota visiting friends when she received a DWI on New Year’s Eve. In representing this client, Mike was successful in negotiating with the prosecutor to allow his client to plead to a lesser charge of Careless Driving. This kept an alcohol-related incident off of his client’s driving record. Mike was also successful in challenging the revocation of the client’s driving privileges through a process called a Petition for Judicial Review. Because Mike got the DWI charge reduced to Careless Driving and the license revocation removed from her driving record, there is no notation on the client’s driving record of any alcohol-related offenses. This also saved her driving privileges in the state of Iowa. Criminal Vehicular Operation Charges Reduced to DWI Mike Brandt’s client was charged in Anoka County District Court with Criminal Vehicular Operation from an incident occurring in December 2014. In the course of investigating the case, Mike uncovered an issue as to how the police acquired the blood sample. Specifically, Mike noted that when the police arrested his client, they asked him for consent to take a blood sample but they didn’t read him a Miranda warning. Based upon that issue, as well as the fact that Mike had his client obtain a chemical dependency evaluation, attend the class that was required, and attend a Mothers Against Drunk Driving Victim Impact Panel, the prosecutor agreed to dismiss the Criminal Vehicular Operation charges and agreed to allow Mike’s client to plead to a lesser charge of DWI. Mike’s client was placed on probation and avoided having a gross misdemeanor conviction for the Criminal Vehicular Operation charge on his record.
