Michael Kraemer is one of the founding partners of KM&A. Michael leads the employment legal team and works on the major litigation cases handled by the firm. He primarily represents employees and former employees regarding their legal issues, but also works with small businesses and parties in civil litigation. Michael represents clients near the firm’s headquarters in Pittsburgh and across Pennsylvania.

Before forming KM&A, Michael founded and managed Kraemer Law Firm, LLC. He centered his practice on employment law issues and, along with an associate attorney, helped a large number of clients achieve successful outcomes in their cases. Recognizing that many employment clients are in hard situations, Michael takes pride in providing sincere attention and strong representation. He is well-versed in the nuances of employment law, and can cut quickly to the most important legal issues in any situation.

Michael is a graduate of the University of Pittsburgh School of Law and the University of Pittsburgh Dietrich School of Arts and Sciences. He has studied and traveled extensively abroad, but always considers Pittsburgh to be his home. He is admitted to practice law in the Commonwealth of Pennsylvania and in the United States District Court for the Western District of Pennsylvania.
How did you build a successful practice?

My successful practice comes from being compassionate, understanding, and knowledgeable. Compassion and understanding of the stressful situations my clients are going through assists both myself and my clients. Having the ability to communicate throughout the process and being transparent throughout the process allows for mutual respect to develop. With my firm assisting our clients through Pennsylvania and New Jersey, we have gained immense knowledge. Being able to apply that knowledge, as well as being in the heart of Pittsburgh and Philadelphia allows our clients' cases to move forward successfully.

What should clients look for in a lawyer?

When looking for a lawyer, you should always look for someone who will fight for your cause. As one of the largest plaintiff law firms in Pennsylvania, my firm has represented and fought for justice for our clients on a daily basis. With being a high-tech firm, our clients are able to ask us about their case without anyone having to look through a filing cabinet to find the answer or next step to their case. We are able to answer their questions immediately. A client should always look for the same transparency our firm offers.

How important is local knowledge to the success of your cases?

It is extremely important to have local knowledge in regards to the success of a case. With our two main offices being in Pittsburgh and Philadelphia, we are able to file and retrieve quickly to any court house in the state. We have had the ability to represent individuals from different areas throughout Pennsylvania, which has expanded our knowledge into every county in Pennsylvania.

What information do you need in a free phone consultation?

During the free phone consultation, our firm will need to know exactly what the legal issue is and supporting background of the legal issue. If you're uncertain of what a root cause is, we will assist in asking specific questions to understand what the circumstances are of your legal issue.

What is the most rewarding aspect of your job?

The most rewarding aspect of my job is being able to give our clients relief and security in knowing that we are fighting for their cause. When an individual is contacting a law firm, it is typically during one of the most stressful times of their lives. With the experience and knowledge my firm has, we are able to be as transparent with our client as possible. Whenever our clients need an answer or an update, we are merely a phone call or email away. Knowing that we are genuinely there for our clients assists in alleviating the stress of going through one of the most terrible times in our clients' lives.

O’Brien, filed suit Thursday against Family Dollar Stores, Inc. on behalf of 15 current and former “Store Managers.” The suit alleges that Family Dollar illegally withheld hundreds of thousands of dollars in overtime wages from these employees. According to the Complaint, the plaintiffs allege that Family Dollar deliberately misrepresented that these employees were exempt from Pennsylvania’s mandatory overtime provisions. In fact, these employees do not qualify for this exemption and are entitled to be paid time and a half for every hour they have worked beyond 40 hours per week. The suit alleges that Family Dollar deliberately understaffed stores, refused to authorize overtime for non-exempt employees, and forced Plaintiffs to work eighty hours or more per week to cover shifts and keep its stores open. Plaintiffs were threatened with termination if they refused to work the extreme hours demanded of them. Their position is that Family Dollar’s actions violate the Pennsylvania Wage Payment and Collection Act, the Pennsylvania Minimum Wage Act and the common law tort doctrine of Unjust Enrichment. Plaintiffs seek to recover damages provided under these laws including compensatory damages, punitive damages, liquidated damages and attorney’s fees. Adverse possession is the legal concept that if the owner of the land isn’t using it, and someone else is giving the land a useful purpose for long enough, the law favors the useful purpose over the land being left unused.
