A partner in Riker Danzig's litigation department, Michael R. O'Donnell provides a range of commercial litigation services to clients, particularly title underwriters and agents, financial institutions, and family-owned companies. His work includes title disputes, mortgage fraud claims, lender liability claims, work-out of problem loans, commercial foreclosure and evictions, sophisticated judgment collections, fraud and fraudulent transfer claims, D&O and fidelity bond issues, and shareholder disputes in closed corporations. Mike has defended title underwriters and agents and financial institutions in class actions ranging from claims of overcharges on settlement services to violations of Expedited Funds Availability Act.

His clients include every major title insurance company, including Chicago Title Insurance Co., First American Title Insurance Co., Fidelity National Title Insurance Co., Lawyers Title Insurance Company, Old Republic Title Insurance Company and Stewart Title Guaranty Company, as well as smaller title insurance companies. As to financial institutions, Mr. O'Donnell has represented almost all major institutions, such as Wachovia Bank, Bank of America, and Wells Fargo, and regional banks as well. Mike also represents Simon Property Group in commercial evictions.

Mike has tried a wide range of commercial cases from lender liability claims to a boundary dispute involving sixteen acres in Southern New Jersey. He has also served as counsel for title companies on numerous real estate frauds in excess of $40 million in claims. Mike also has litigated several oppressed shareholder matters, including a 31-day trial on a $30 million family-owned real estate business. He also lectures on title insurance and banking matters and authored a number of articles on title and banking issues.

Among Mike's career highlights is his involvement in a fidelity bond case that resulted in the Resolution Trust Corp. receiving a $23.5 million payment from an insurance company for a bank officer's misdeeds, which resulted in the largest recovery on a fidelity bond in RTC history. He also represented a financial institution in the successful defense of a class action alleging over $100 million in damages relating to its funds availability policy.
