The substitution of a new contract for an old one. A novation may change one of the parties to the contract or the duties that must be performed by the original parties.

(1) A lack of physical or mental abilities that results in a person's inability to manage his or her own personal care, property or finances. For example, if the landlord refuses to provide heat or water or refuses to clean up an environmental health hazard, the tenant has the right to move out and stop paying rent, without incurring legal liability for breaking the lease.

The work made for hire status of a work affects the length of copyright protection and termination rights.
