Rebecca has always been a defense attorney. Even while in law school, she did her internship with the public defender’s office in a rural county in West Virginia. Sexting Case (Hillsborough County) The case result for this case is as follows: Juvenile Prosecution Hillsborough County January 2012: 2012-CJ-XXX 14 year old Juvenile was referred for prosecution for felony transmission of pornography over the internet after “sexting” other students at school email video clips. This case had the potential of a “sexual predator and or sexual offender” designation status, following the student the rest of their life. This case was handled by Hamilton Law Services early and aggressively, included correspondence with law enforcement, parents and grandparents, as well as mental health professionals. This case was NOT PROSECUTED by the Hillsborough County State Attorney’s Office. TRAFFICKING IN HYDROCODONE Case No.: CRC10098XXCFANO- TRAFFICKING IN HYDROCODONE County: Pinellas Facts: On May 5, 2010, our client was a passenger in a vehicle that was pulled over by the Largo Police Department. In the passenger side door of the vehicle was a tiny baggie with Hydrocodone pills not belonging to my client. He was arrested for Trafficking in Hydrocodone and was given a $50,000 bond. Outcome: The Client came to Hamilton Law Services within days of this incident. Hamilton Law Services successfully persuaded the Prosecutor (State Attorney’s Office) not to file formal charges against my client after being presented with a full legal brief with case law cited. The memorandum presented and researched by Hamilton Law Services showed that the State Attorney could not prove to a Judge or Jury a Constructive Possession Case. TRAFFICKING Case No.: CRC11-007XXCFANO-- 2 COUNTS TRAFFICKING OXYCODONE, OBTAINING OXYCODONE BY FRAUD, OBTAINING ALPRAZOLAM BY FRAUD, 2 COUNTS DOCTOR SHOPPING County: Pinellas Facts: In January of 2011, client is arrested by Pinellas County Sheriff’s Office while arriving at her doctor’s office for a scheduled appointment and is booked on six counts of charges outlined above, bonds totaling: $90,000. Outcome: Client immediately hired Hamilton Law Services who was able to convince the State Attorney’s Office not to file trafficking or Doctor Shopping charges. This was done in 3 weeks and client was able to get her bond down to $20,000. She plead to probation on 2 Counts of Withholding Information from a Practitioner and is eligible to be terminated from probation early in 18 months. BATTERY Case No.: CTC10121XXMMANO 2 COUNTS BATTERY COUNTY: Pinellas FACTS: On May 16, 2010, a middle aged man with severe physical disabilities is riding a handicap scooter down a neighbor’s culdesac when he was harrassed by some neighborhood kids and later physically attacked by two off-duty law enforcement officers. Although the disabled man was severely injured, HE was charged with battery on the 2 off-duty law enforcement. OUTCOME: Client hired Hamilton Law Services to take his case to trial. Hamilton Law Services obtained a NOT GUILTY verdict on both counts from the jury. AGGRAVATED BATTERY Case No.: CRC10059XXCFANO-- AGGRAVATED BATTERY COUNTY: Pinellas FACTS: In March of 2010 this man was arrested for aggravated battery after his girlfriend came back home from a nearby bar with a black eye and broken nose. She had a history of drinking and hurting herself. He was charged with Aggravated Battery, a second degree felony, facing a maximum penalty of 15 years of prison with a minimum mandatory prison sentence of 24 months. OUTCOME: Client hired Hamilton Law Services to represent him at trial. After preparing thoroughly by taking depositions and doing independent investigations, Hamilton Law Services convinced the jury the client did not cause great bodily harm and obtained a jury verdict of a lesser included misdemeanor battery. AGGRAVATED CHILD ABUSE Case No.: CRC10102XXCFANO AGGRAVATED CHILD ABUSE COUNTY: Pinellas FACTS: In May of 2010 this hard working father with no criminal record was arrested on two counts of aggravated child abuse, alleging to have attempted to choke his teenage daughter with a USB cable cord in a fit of rage while his other teenage daughter was allegedly thrown on the couch. OUTCOME: The Client immediately hired Hamilton Law Services who successfully intervened on his behalf to the State Attorney’s Office, who did not file any formal charges against the client. FELONY BATTERY Case No.: CRC07055XXCFANO FELONY BATTERY COUNTY: Pinellas FACTS: In April 2007, this man was arrested for domestic battery on his girlfriend. There were no independent witnesses, merely a “he said, she said.” Because he had a prior battery conviction, this client’s misdemeanor’s arrest was elevated to a felony. OUTCOME: This man hired Hamilton Law Services, adamant of his innocence and desire to take his case to trial. In August of 2007, he had his day in trial and was vindicated when the jury came back with a NOT GUILTY verdict. AGGRAVATED ASSAULT WITH A DEADLY WEAPON Case No.: CRC09075XXCFANO COUNTY: Pinellas FACTS: In April of 2009, this man was at a Rays game at Tropicana field in St. Petersburg, when he was harassed in the men’s restroom. He is alleged to have lunged at others with a knife. He is arrested for Aggravated Assault with a Deadly Weapon, a third degree felony with a maximum penalty of 5 years prison. OUTCOME: The Client immediately hired Hamilton Law Services who successfully intervened on his behalf to the State Attorney’s Office. Hamilton Law Services was able to negotiate a plea down to two misdemeanors for a withhold of adjudication (non-conviction). This disposition left client in a position to have the arrest and charges sealed from his record, enabling him to lawfully deny ever having been arrested in most circumstances. Case No.: CTC10253XXXXMMANO ARMED ROBBERY COUNTY: Pinellas FACTS: In June of 2010, this man was arrested for walking out of CVS pharmacy and poking the manager in the face with his car keys after being accused of attempting to shoplift. He was arrested on Armed Robbery, a felony punishable by up to Life in prison. OUTCOME: This man hired Hamilton Law Services, adamant of his innocence and desire to take his case to trial. Hamilton Law Services intervened on his behalf and secured a lesser charge being filed against client of misdemeanor battery. On his trial date, client pled to a withhold of adjudication (non-conviction) on the misdemeanor and time served, because it was in his best interest to do so. Barring any other convictions on his record, he is eligible to have this arrest and disposition sealed from his record.
