Juchniewicz v. Merez Food Corp Practice Area: Personal Injury Date: Oct 12, 2009 Outcome: Settled just before jury selection for $3,000,000.00 Description: HVAC repair man fell from interior fixed ladder when his hand struck an object as he was climbing to the roof to repair a refrigeration system. Fractured wrist with multiple surgeries and cervical disc herniation with two surgeries. There were no complaints of neck pain until nine months after the accident. Summary judgement on liability under New York State Labor Law section 240. Walsh v. Leviev Fulton Club Practice Area: Personal Injury Date: Oct 13, 2010 Outcome: Settled for $458,000 prior to jury selection. Description: Electrician's helper was told to remove circuit breakers from an electrical panel during a building demolition and reconstruction project. He knew the panel to be "live" and proceeded to remove the breakers anyway which resulted in an electrical arc and explosion that gave him third degree burns to his forearm requring skin graft surgery.
