A graduate of Duke Law School, Mr. Willstatter learned trial lawyering as a public defender before entering private practice in 1989. The focus of his practice is the defense of state and federal criminal prosecutions. He represents individuals and companies who are the subject of grand jury subpoenas and interfaces with the United States Attorney's Office and case agents in such matters. Mr. Willstatter has represented many persons charged with crimes in the state and federal courts and frequently represents clients on appeal.
Mr. Willstatter is a member of the Board of Directors of the New York State Association of Criminal Defense Lawyers (NYSACDL). He serves as the Chair of the NYSACDL Amicus Curiae ("Friend of the Court") Committee. The Committee submits briefs on selected issues of statewide importance in the appellate courts. Mr. Willstatter is also Second Circuit Vice-Chair of the Amicus Curiae Committee of the National Association of Criminal Defense Lawyers (NACDL). In addition, Mr. Willstatter serves as Vice-Chair of the NACDL's Mental Health Committee.
Mr. Willstatter has delivered numerous Continuing Legal Education lectures for the NYSACDL on such topics as Current Appellate Issues, the Federal Rules of Evidence, Fingerprint Evidence and the Cross-Examination of a Forensic Chemist.
In June 2006, Mr. Willstatter published an article in the magazine of the NACDL, The Champion, entitled "The Federal Criminal Mental Competency System." He has written other articles including one entitled "Dealing with Fingerprint Evidence: Confronting the Prosecutor's Evidence and Creating Your Own" in the January/February 2003 issue of Atticus, the NYSACDL newsletter, and another entitled "Habeas Corpus Challenges to the Federal Bureau of Prisons' New Policy on CCC Placement" in the May/June 2004 issue. Mr. Willstatter publishes a monthly column on the activities of the Amicus Curiae Committee in Atticus.
Mr. Willstatter is a member of the Westchester County Bar Association.
