Whelan, Prescott, was disbarred, effective the date of the order. Mr. Whelan was ordered to pay restitution in the amount of 0,646.90. Mr. Whelan was also assessed the costs and expenses of the disciplinary proceeding, in the amount of Professional Liability Insurance: No More About: Mr. Thomas J Whelan , Educated at Thomas Jefferson, admitted to practice in 2004, admitted to the State Bar of Arizona December 21, 2004. Year Admitted To Practice In: 2004,120.06. Mr. Whelan represented a couple who had purchased a house that needed repairs due to a problem with the sewage system. The clients retained Mr. Whelan to represent them in a lawsuit for failure to disclose the sewage problem. Mr. Whelan did not inform them that if they lost the case they could be subject to payment of the opposing partys attorneys fees. The clients lost at arbitration and the arbitrator awarded one of the opposing parties ,000 in attorneys fees. At this point, the clients advised Mr. Whelan they did not want to appeal anything except the award of attorneys fees. The clients later found out that Mr. Whelan had appealed the entire judgment.
