Every once in a while, we get a case where an individual, family or business feels like they have no legal recourse after hearing nothing but "no" or "there's nothing we can do" or "you have no other options." These cases are the most challenging because of the confusion and ongoing stress for all involved. A boy with sickle cell anemia came to the US with his family for medical treatment, which required a bone marrow transplant with an older brother as the donor. The entire family entered the US on a B1 visa, unfortunately, there were complications that required an extended stay when the hospital made several errors: (1) they only filed an extension for the son, not the entire family; (2) they failed to respond to a CIS request for evidence; and (3) they failed to notify the family when the petition was denied. One of these oversights is stressful enough, but all three put the family in a very challenging situation. Since the 180-day status window had passed, the family was illegally in the country and at risk of being denied entry to the U.S. in the future. An appeal was filed and rejected due to errors in the submission, and a second motion was denied due to a passed deadline. Given everything that had already gone wrong with the case the extended stay due to medical complications, the hospital errors in the extension filing, the rejected appeal and denied motion this resolution required a nontraditional approach. Since CIS would no longer accept additional documents after the filing, Anu Gupta called CIS several times to provide clarity surrounding the long list of issues, errors and oversights. Due to Anu's compassion, expertise and persistence, she received clearance to resubmit the already filed Motion to Reopen directly with the CIS director's office, and the motion was accepted. Within two months, the entire family was granted visas, allowing them to focus all of their attention on what was most important: the health of the ailing family member. A lawyer should always listen to you, no matter how busy they are, and treat you with respect. A lawyer should also be honest and explain both the case and the upfront costs.

Extremely important. When filing for a work visa, the attorney must understand the industry and the job duties to be able to get the case approved. When filing family based cases, it is important to understand which USCIS office it will go to, how they deal with those cases and how much time it takes so you can advise whether they can leave the US or when they can start work etc.
