Please describe a case in the last year or two where you made a big difference.

We were honored to represent the family of Captain Kenneth Harris, a longtime West, Texas resident and City of Dallas firefighter. Captain Harris was off-duty in West the day that the Adair Grain Company caught fire. He rushed to aid fellow firefighters and tragically lost his life in the West explosion. Through careful partnership with local McLennan County lawyers, our firm was able to prepare and settle the Harris family's claims. While nothing can bring Captain Harris back, we were proud to honor him and to assist his family in their moment of need.

How did you build a successful practice?

From the outset, when I began my law practice, I intently focused at perfecting both my knowledge of the law and the trial tactics that were necessary to obtain results from my client. That took a tremendous amount of time, energy, and focus. However, once that occurred, it showed me that I could advocate against peers with decades of more experience than me. My results mirrored my preparation, and clients, colleagues, and judges began to see they could trust my ability and ethics. Many years later, I still believe that early bedrock serves as the key to my practice.

What should clients look for in a lawyer?

At the end of the day, results are what distinguish a good attorney from an exceptional lawyer. Every client should expect their lawyer to be responsive, knowledgeable and professional. Consistent results achieved through creative and aggressive solutions are what really matter to a client. Our record speaks for itself. Stated differently, I believe our past results are a prediction of the future ones we can achieve for our clients.

How important is local knowledge to the success of your cases?

Local knowledge is one important factor. Knowing the lawyers around you and them knowing you is critical. The same is true for judges - knowing their tendencies and preferences, while instilling in them the confidence that you are competent, superior to your opponent, and highly-skilled. Reputation matters. Our firm's reputation speaks for us.

What information can you provide in a free phone consultation?

Our phone consultations are an introductory conversation to learn the facts and circumstances of your case. Once that occurs, you will get some explanation (either in the call or shortly thereafter) of the law pertaining to your potential case and how we see the law applied to your facts and circumstances. We do not sugarcoat matters. You will receive an honest assessment of our professional judgment including your strengths and - most importantly - your weaknesses. Upon request, we can also address potential fee arrangements.

What information do you need in a free phone consultation?

Every potential client needs to take comfort that there is no pressure or set expectations for a consultation. You are likely not a lawyer and have no legal training. That's okay. We can help direct you if we need information you might not have. An initial consultation is an overview of matters. You should be able to provide the names of the interested parties (you, anyone working with you, and anyone working against you), critical dates in time when matters occurred, and some general idea of what you would see as a successful outcome for you. My rule of thumb is simple: be able to tell your story with as much specificity as you possibly can.

What differentiates you from other lawyers in your community?

Many lawyers claim to be able to try a lawsuit, but can they really do it and do it well? I am one of about 50 lawyers in the State of Texas with my level of board certifications. My peers have recognized me as displaying exceptional professional and ethical standards. Most importantly, I treat my clients like my family. My cell phone is never turned off. I'm available and accessible because, for almost every client, their legal dispute is one of the most challenging, anxiety-producing, and scary times in their life. In that spirit, every fee arrangement I take requires me to make some form of investment in the case - assuring my clients that we are linked together as partners in their matter.

What is the most rewarding aspect of your job?

There is no question that having a client turn to you and simply say ""thank you"" is the greatest joy you can ever have. Earning a client's appreciation and knowing you made his/her/their lives better is why I do what I do. Some believe the practice of law is a business. I see it as a professional calling.

What are your other interests in addition to law?

Most of my time outside of work is spent with my wife and two sons. I take the time to coach many of their sports teams and enjoy various forms of exercise, myself.

Are you involved in your community?

I believe that giving back to your community is critical - a value that my wife and I sternly enforce in our sons. We also spend a significant amount of time at church and doing other forms of community service. I serve on several non-profit boards and foundations. I am also an active supporter of several local EMS and fire organizations, including a lecturer and instructor on legal matters for them.

  • SIMMS V. JONES
    Plaintiff: Attorney for the plaintiffs, Steve Simms et al. The plaintiffs' sued the NFL and the Cowboys Football team for breach of contract. Super Bowl game tickets were sold by the NFL and then resold at a markup by the Dallas Cowboys Football Team. Upon review of the case the court finds that no breach of contract occurred. The motion for dismissal by the NFL and the Dallas Cowboys is granted.

  • FUDGE v NEW PRIME INC.
    Attorney for the Plaintiff in a wrongful death case that resulted in a $3.35 million dollar award. The case involved the wrongful death of a driver and serious injury of her sister when a truck owned by New Prime Inc. ran the victim's car off of the road while changing lanes. Although the Defendant (New Prime Inc.) denied involvement, the surviving victim recognized their logo on the truck before the accident occurred. Ayers (attorney) presented evidence from the company’s global tracking system that showed at least two of their trucks were in the area at the time of the accident.
