David J. Taylor has been in private practice for four decades, primarily in the fields of government contracts, complex civil litigation, construction, international commercial and trade law, antitrust, communications and technology law. He is co-chair of the Government Contracts Practice Group.

David primarily counsels clients and litigates in the area of government contracts, with particular emphasis on bid protests, requests for equitable adjustment and claims, compliance programs, and contract terminations and close-outs. He has counseled a variety of both large and small businesses and not-for-profits on the full range of federal procurement issues. He has litigated many cases before the United States Court of Appeals for the Federal Circuit, the United States Court of Federal Claims, the GAO, the Boards of Contract Appeals and various agencies. He is an advocate of and very experienced in alternative dispute resolution (ADR) techniques.

David has counseled clients and/or litigated in a variety of government contracts issue areas including contract formation, "best value" analyses, cost accounting regulations, contract changes and claims, teaming arrangements, co-operative agreements, subcontracting, non-disclosure agreements, FOIA requests, representations and certifications, commercial item contracting, foreign content regulations, suspension and debarment, Foreign Corrupt Practices Act, intellectual property rights, novations, and a wide variety of small business and socioeconomic issues. He has experience in the development and implementation of internal compliance programs and internal investigations and in the preparation of Federal False Claims Act defenses. He has also effectively employed the government contractor defense to protect contractor clients from claims made by third parties.

David's bid protest practice has included extensive protests of awards to competitors, defending his clients' awards against the protests of others, and negotiating and monitoring corrective action by agencies. He has been involved in court bid protests since the earliest days he assisted in the preparation of the Scanwell decision as a law clerk to Judge Tamm on the United States Court of Appeals for the District of Columbia Circuit in 1970.

David has extensive experience in converting terminations for default into terminations for convenience. In the bid protest arena, he took one case from the filing of the complaint in the Court of Federal Claims to an award of a permanent injunction in favor of his client in just 10 days.

David has advised clients on many aspects of the cost accounting regulations, including requirements for submission of cost and pricing data, home office expenses, legal fees, relocation expenses, tax refunds, termination costs, independent research and development costs, and general and administrative costs, and has helped small business clients prepare claims for and obtain Equal Access to Justice Act legal fees.

David was a member of a team that persuaded the U.S. Army Corps of Engineers to take corrective action after it incorrectly evaluated price proposals for the Advanced Contract Initiative Debris Removal and Reduction contract, valued up to $2.5 billion over five years. The corrective action came after the attorneys assisted a client in filing a substantial protest with the Government Accountability Office highlighting a multitude of flaws in the evaluation process, including unbalanced pricing, unequal discussions and a failure to follow the stated price evaluation plan. The corps elected to acknowledge and correct the flaws at the start of litigation, rather than to continue through the lengthy protest procedure.

David also was part of a team that received a favorable decision following a three-day trial and extensive post-trial briefing that resulted in the Armed Services Board of Contract Appeals handing a client a complete victory on two claims under the client's large, emergency contract with the Army Corps for debris removal services in Mississippi following Hurricane Katrina.

Upon graduation from Georgetown Law Center in 1969, David served as law clerk to the Honorable Edward A. Tamm on the United States Court of Appeals for the District of Columbia Circuit.

David has been a frequent speaker and has authored many articles on government contracting.

David is fluent in French. He is admitted to practice only in the District of Columbia.

Physician Obtains Downward Modification to Alimony Obligation
In a post-judgment divorce action, a physician was successful in obtaining a downward modification to his alimony obligation due to a substantial decrease in his income.  The parties were divorced back in 2007, and pursuant to the judgment of dissolution, the husband was required to pay alimony to the wife in the amount of $6,000 per month for a period of eleven months, followed by $5,000 per month thereafter.  The amount of the alimony obligation was modifiable upon a substantial change in circumstances in accordance with Connecticut General Statutes § 46b-86.
In Post Judgment Divorce Action, Court Determines that $1.2 Million Payment to Husband was Income, Not Liquidation of an Asset
In a post-judgment decision rendered, the Superior Court of Fairfield at Bridgeport addressed whether a payment that a husband received from his employer after the parties’ divorce constituted an asset or, alternatively, income.  The parties in this action obtained an uncontested divorce in 2008.  As part of their separation agreement, the husband was obligated to pay the wife child support in the amount of $1,600.00 per month.
Child Care Costs and the Connecticut Child Support Guidelines
In a decision rendered previously, the Connecticut Appellate Court explained the definition of “child care costs” as set forth in the Connecticut Child Support Guidelines.  In that particular case, the parties were married for approximately five years and were the parents of two minor children.  During the year of 2003, they entered into a custody stipulation which was subsequently incorporated into a comprehensive separation agreement.  The separation agreement provided that the husband would pay the wife $2,500 per month in unallocated alimony and child support for a period of five years, followed by straight child support.
