Please describe a case in the last year or two where you made a big difference.

In 2014, we had a case in which we represented a plaintiff/driver who sustained a fractured hip and other injuries in a motor vehicle collision. His vehicle was traveling on the highway when it spun out in inclement weather. Our client's vehicle came to rest facing the wrong direction but fully located in the breakdown lane. Our client got out of his vehicle. He then called for assistance as he could not turn the vehicle around on the highway. He then got back in his vehicle as it was raining. His vehicle was then hit head-on by a second car which also spun out on the highway in the same inclement weather. Both insurance companies for the two drivers assessed the parties as equally at fault. Not a single offer was made to settle the claim. We believed that our client's version of events was credible and that the defendant/driver was negligent for traveling too fast for the weather conditions. He was also driving too fast considering the presence of a vehicle backwards in the breakdown lane. The defendant and his insurer claimed this was one simultaneous motor vehicle collision and that the defendant witnessed the plaintiff's vehicle spin out and then did the same. However, we maintained that there were two separate and distinct motor vehicle incidents. The first incident involved only our client's vehicle and resulted in no personal injury and minor property damage. The second incident resulted in serious personal injury to our client and a total loss of both vehicles. The two incidents occurred on the Massachusetts/Rhode Island state borders so emergency calls reporting them were directed to both Massachusetts and Rhode Island. Through a Keeper of Records Subpoena and a Motion in Rhode Island, we obtained records of twenty-eight emergency calls during the relevant time period of these two incidents. These records established a timeline and evidence that there were two separate and distinct motor vehicle incidents and that the defendant's version of events was not credible. The case went to arbitration before a panel of three arbitrators who believed the plaintiff. They awarded him $120,760.00. This began as an extremely difficult case to prove. Due to thorough research and investigation of all the facts, the plaintiff received a monetary judgment in his favor in a case in which both his insurer and the defendant's insurer thought he should receive nothing.

How did you build a successful practice?

We built a successful practice by working hard on each of our client's cases. We try to resolve each case that comes into our office at the early claims stage before litigation is ever initiated. We do extensive legal research and tailor our work to the specific needs of each case. We work well with other attorneys and have built a reputation as being credible, intelligent, consistent, polite, yet always zealous advocates for our clients. We move claims and cases forward and take seriously the fact that, as plaintiffs' attorneys, the burden is on us to move the case forward to resolution. As plaintiffs' attorneys we don't get compensated unless our clients recover an award for their injuries. As a result, we take the responsibility of investing our time and attention into our clients' cases seriously. We take relationships with our clients personally. We keep our clients informed of what is occurring in their cases. We return phone calls. Our clients often call us long after their cases have resolved with regard to other legal issues. If we can't help them, we will find an attorney who can.

What should clients look for in a lawyer?

Clients should hire a lawyer for the same reasons that they would hire any other professional or contractor. They should look for a lawyer who is knowledgeable, sincere, trustworthy and hard-working. They should also find one who is willing to listen and answer questions. A lawyer should explain the law in a manner so that the client can make informed decisions regarding the claim or lawsuit. When a person is injured in an accident, there are so many immediate issues to resolve. The first and foremost are often issues of navigating insurance payments so that medical bills are paid. We start here with each case and move forward all the way to a resolution of each claim or lawsuit against an at-fault party.

What information can you provide in a free phone consultation?

We spend as much time as necessary in a phone consultation to help a person calling our office understand whether or not they have a potential claim for their injuries and damages. We take phone consultations very seriously since the majority of our cases come from an initial phone call to our office. If we can't help a caller with their particular legal issue, then we always refer them to someone who can. No claim or case is too small. We handle cases with hundreds of thousands of dollars in medical bills and cases with hundreds of dollars in medical bills. Every potential caller to our office is a potential client. We treat them all with the same courtesy and professionalism.

What is the most rewarding aspect of your job?

The best part of being a lawyer is the satisfaction that comes from helping someone who is really having a difficult time in their life due to the real effects of an injury on a person's ability to work, pay medical bills and even get their property damage claims resolved. We have received numerous letters and emails from clients over the years who thank us for helping them with their cases. Over ten years ago, we represented an elderly man who suffered a broken hip in a fall the first day he was admitted to a nursing home. The case went to trial and the jury found for the plaintiff. He and his wife have since passed away. Before she died, his wife sent us a letter thanking us for our work on his case. She told us how they were able to use some of the money they were awarded to take a dream vacation which included a first-class airplane flight. As a result of the fall, the husband suffered from chronic hip and leg pain and could not travel far in a vehicle. However, because of the first-class ticket, he was able to spread out his legs on the flight and be comfortable. In another case, a group home administrator personally apologized to the family of an injured gentlemen during a mediation. The apology meant more to the family than the settlement money they received that day. Rewards like that are the best part of this job.
