State v. Lenarz Practice Area: Criminal Defense Date: Jul 19, 2011 Outcome: Conviction Reversed and Charge Dismissed Description: Clients conviction was appealed to the Connecticut Appellate Court on two grounds both of which had been raised with the trial court. The main issue involved the attorney client privilege as provided by the Sixth Amendment to the United States Constitution. In July of 2011, the Connecticut Supreme Court released its decision – a complete dismissal of the sole conviction. The Court held that “the taint caused by the state's intrusion into the [attorney client] privileged communications would be irremediable on retrial and the charge of which the defendant was convicted must be dismissed.” State v. Doyle Practice Area: Criminal Defense Date: Jan 24, 2011 Outcome: Nolled (dropped) at Trial Description: Client was charged with Larceny and Criminal Trespass. The alleged victim claimed that the defendant stole various scrap metal and a steel frame from her property. The client adamantly denied that he stole anything and explained he had permission to take the property as payment for odd jobs that he did for the alleged victim. The client rejected all plea bargains and elected a trial. After a week of jury selection and on the day evidence was scheduled to begin the state attorney entered a nolle, which means that the state chose not to pursue the charges. Description: Client charged with attempted assault in the first degree with firearm, assault in the second degree, criminal possession of a firearm and interfering with an officer.
