Litigation | Court of Appeals reversed dismissal of claim. Found that Statute of Repose applied to the claim | Subrogation action for recovery of Insurance Proceeds paid due to wall collapse. Issue was whether the case was barred by the general negligence statute of limitations. Counsel argued that the Statute of Repose applicable to improvements to real estate applied.
