(1) The house in which a family lives, plus any adjoining land and other buildings on that land. After the head of the family dies, homestead laws often allow the surviving spouse or minor children to live on the property for as long as they choose. The term 'homesteaders' refers to people who got their land by settling it and making it productive, rather than purchasing it outright.

For example, Alvin loses control of his car and accidentally sideswipes several parked cars. When the first car owner sues Alvin for damages, the court determines that Alvin was legally drunk at the time of the accident. Alvin will not be able to deny this fact in subsequent lawsuits against him. This type of estoppel is most commonly called collateral estoppel.

A legal principle or rule created by one or more decisions of a state or federal appellate court. These rules provide a point of reference or authority for judges deciding similar issues in later cases. Lower courts must apply these rules when faced with similar legal issues. For example, if the Montana Supreme Court decides that a certain type of employment contract overly restricts the right of the employee to quit and get another job, all other Montana courts must apply this same rule.
