Commissioner of Public Safety Practice Area: DUI & DWI Date: May 10, 2005 Outcome: Breath Test Suppressed - DL Revocation Rescinded Description: In this case, the Minnesota Court of Appeals first acknowledged that a DWI Defendant has the right to obtain an additional test sample while in jail in the receptacle of his or her own choosing, as long as the receptacle is brought to the jail by a person of the driver's own choosing.
