• Criminal Defense | All evidence suppressed. The State Attorney appealed to the Illinois 3rd District Appellate Court where the trial court's decision was affirmed | The State's offer on this case was for 5 years of incarceration in the custody of the Illinois Department of Corrections. Essentially a vehicle was disabled in the median of the interstate, and the driver had an outstanding warrant. Passenger/Client was ordered to sit where the Officer could see him while processing the driver. Client was patted down for officer safety whereupon a pill bottle was discovered around the client's neck. Client told the officer it contained pills, and a second officer advised the first that they could not let the client leave the scene without knowing what was in the bottle. The bottle was then seized. This bottle allegedly had U.S. currency, and a number of controlled substances. At hearing on our motion to quash the arrest and suppress evidence and statement's given the Judge agreed that the client was seized for 4th Amendment purposes at the moment the officer instructed client to sit and wait. The case was ultimately dismissed as no evidence was admissible at trial. DUI and DWI | Rescinded | Since I take detailed notes and send out subpoena's for all DUI cases I had a client who was faced with a pending DUI charge and a Summary Suspension that was approaching quickly. The suspended license would drastically impact my client's employment and through viewing the dash camera footage and reading the officer's report it was clear that the initial stop took place while the client was parked on private property. Ultimately the license suspension was lifted because under the implied consent statute, the impaired driving must take place on a publicly maintained road/highway for the Secretary of State to be able to suspend a driver's license. There was a recent case with one charged class 2 felony, one class 3 felony, with the possibility of a minimum of three class X felony counts that were indictable. This would have placed my client in a situation where they were facing 28-100 years in the Illinois Department of Corrections as the offenses were mandatory consecutive. After having a meeting with the elected State's Attorney we were able to reach a consensus that the evidence supporting the class X charges would likely be suppressed as fruits of a warrantless search, the client was able to receive a 5 year sentence with day for day credit, and was eligible for a 6 months of good time credit, bringing down the sentence to 24 months in custody.
