About Mark
Mark Fishman practices in the areas of bankruptcy law, debtor-and-creditor, healthcare insolvency, and related litigation, representing debtors, creditors' committees, trustees, bondholders, purchasers of assets, landlords and parties to litigation both in bankruptcy courts and in other courts. He graduated from Harvard Law School in 1970. Following completion of a judicial clerkship with the Supreme Judicial Court of Massachusetts, Mr. Fishman joined Sullivan & Cromwell in New York, New York, where he practiced corporate and commercial litigation until 1978. He commenced practicing law in Connecticut shortly thereafter, placing greater emphasis on bankruptcy law and related matters.
Mr. Fishman served as operating trustee and as counsel in the Chapter 11 case of Cuisinarts, Inc., in which unsecured creditors, who had been expected to receive no distribution, received $0.54 per dollar of claim. In that case, the Court found that Mr. Fishman and his chief operating officer efficiently and expertly operated the debtor's business. Mr. Fishman has been serving as lead counsel to the debtor in the New Jersey Chapter 11 case of Whitestone Products, Inc., which was a national manufacturer of incontinence products, and assisted the debtor in preserving and selling its business as a going concern just four months after the petition. Among other cases which Mr. Fishman has successfully handled and which culminated in confirmed Chapter 11 plans are Northeastern Conference Nursing Home, Inc. (service as operating Chapter 11 trustee in the Southern District of New York), Spring Air Partners (service as lead counsel to Creditors' Committee in Southern District of New York), Ahead Communications Systems, Inc. (representation of Creditors' Committee in District of Connecticut), Power Designs, Inc. (representation of secured creditor in Chapter 11 case of publicly-owned company), First Connecticut Small Business Investment Company (representation of Creditors' Committee as co-counsel in case involving a 100% plan), Edal Industries, Inc. (representation of operating Chapter 11 trustee), and Tridex Corporation (representation of Creditors' Committee in Chapter 11 of publicly-owned company).
Mr. Fishman has lectured on bankruptcy law to various groups, including the Connecticut Bar Association annual meeting, groups of bankers and business owners, and law students. He has participated in various professional organizations, including the Advisory Committee to the State Law Revision Commission on repeal of Article 6 of the Uniform Commercial Code and the Executive Committee of the Connecticut Bar Association Section on Commercial Law and Bankruptcy. He served as Chairman of the Commercial Law Section of the Greater Bridgeport Bar Association and Co-Chairman of the Bankruptcy Committee of the Regional Bar Association.
