Michael Rogers primarily represents national and regional automotive dealership clients in a wide variety of legal matters including consumer actions and complex litigation, federal and state regulatory matters, unfair competition claims, commercial and consumer litigation, labor and employment issues and franchise disputes. He has significant experience in effectively resolving high-stakes litigation and providing counsel for litigation avoidance and regulatory compliance. In addition to automotive dealerships, his clients include automotive affiliated businesses such as finance companies, flooring lenders, automobile service centers, and surety bonding companies. In addition to his extensive understanding of the complexities of the automotive industry, Michael’s particular experience includes successfully representing individuals and business entities in complex, catastrophic personal injury matters including products and premises liability litigation; representing employers on a wide range of employment issues including discrimination, wrongful termination, harassment, and wage and hour violations; and representing clients involved in breach of contract, unfair business practices, trade secret violations, and UCC litigation. Known for his straightforward, sensible and strategic approach, Michael also works hand-in-hand with clients in business transactions including corporate, partnership and limited liability company formations as well as business stock and asset sales, real property acquisitions, and commercial leases. While in college, Michael spent his summers working for the U.S. Forest Service as a wildland firefighter, including as a Hotshot and Smokejumper, parachuting into remote wilderness fires. Now he fights battles in the legal arena instead of the forests. His clients and courtroom adversaries find that the “in the trenches” work ethic Michael acquired as a firefighter makes him an exceptional advocate. Michael earned a Bachelor of Arts degree from the University of San Diego and his Juris Doctor degree from the University of San Diego School of Law. Gregory T. Babbitt received his undergraduate degree from the University of California, Santa Barbara (B.A., Political Science, 1993) and his law degree from Syracuse University College of Law (J.D., 1997). While in law school, Mr. Babbitt clerked for California Court of Appeal, Associate Justice Richard D. Huffman. Mr. Babbitt has dedicated his career as a California lemon attorney to protecting consumers. Prior to joining the California auto fraud law firm of the Auto Fraud Legal Center, Mr. Babbitt was a Deputy Attorney General for the Pennsylvania Office of Attorney General, Bureau of Consumer Protection (1998-2001), where he investigated and litigated fraudulent and deceptive business practices in the areas of automobile sales and repairs, home improvement, predatory lending, and debt collection. This experience served as the catalyst to his current California lemon law and auto fraud practice. Mr. Babbitt currently handles California car lemon and auto fraud cases (individual and class actions), and new and used California Lemon Law cases. He has obtained significant recoveries for consumers in a variety of areas, including the sale of prior rentals, demonstrators, lemon law buy-backs, salvage, flood damaged, and prior wrecks without disclosure, and for packing – a practice that involves the sale of items such as alarms, window etching, paint and fabric protection, GAP insurance, or warranties without the purchaser’s request or knowledge. In January 2005, Mr. Babbitt was trial counsel with Douglas Law for the trial of Robertson v. Fleetwood Trailers of California (Tulare County). A cracked shower drain caused water to leak into the underbelly of the Robertson’s trailer and mold to grow there. After trial, the jury ordered Fleetwood to repurchase the Robertson’s trailer and pay a civil penalty for failing to repurchase the trailer prior to the lawsuit being filed. Mr. Babbitt is a member of the State Bar of California, the State Bar of Pennsylvania, the State Bar of Arizona, and National Association of Consumer Advocates (NACA). Josh Green is a former federal prosecutor who joined the Auto Fraud Legal Center LLP in 2023. Josh served as an Assistant U.S. Attorney with the U.S. Attorney’s Office for the Southern District of California for more than seventeen years. Josh was the Chief of the Majors Frauds and Public Corruption Section at the U.S. Attorney’s Office, and he has considerable experience prosecuting cases involving deceptive, fraudulent, and predatory practices.
