SLIP & FALL April 2013, $589,000 verdict Ms. Zeise successfully completed a two week jury Trial in Rancho Cucamonga, a very conservative venue for plaintiffs. Defendant contested both liability and damages in this three vehicle accident. Defendant alleged that plaintiff had a five year prior history of neck pain and argued that he only sustained soft tissue injuries. Plaintiff was last seen for neck pain five days before the accident. The defense contended that plaintiff was fully recovered after six months of treatment. The pre-trial offer was $87,500 with a credit of $87,500 for monies paid by a co-defendant. After a two week Trial, the jury returned a verdict for $589,800.00 for plaintiff. VEHICLE ACCIDENT January 2013, $500,000 settlement In January, 2013, in the case of Joseph v. Medical Investment, Ms. Zeise prepared for Trial regarding a case arising out of a three vehicle, rear-end collision. Again, the defense contested both liability and damages. Plaintiff asserted he was a surgical candidate for a low back fusion. Defendant argued the low back surgery was unnecessary and was never going to occur. Plaintiff incurred less than $10,000.00 in medical expenses. The last pre-trial offer was $50,000.00. The evening before Trial at the beginning of Plaintiff's doctors deposition, the $500,000.00 policy limits was tendered. VEHICLE ACCIDENT June 2012, $1.5 million settlement In June of 2012, Ms. Zeise tried the case of King v Carballo in Indio Superior Court. Plaintiff was driving a UPS truck which was disabled on the 60 freeway when it was rear-ended by another semi-tractor trailer. Plaintiff contended he needed low back surgery and could not continue his career at UPS. Plaintiff was still working for UPS at the time of the Trial, although he had frequent absences. Defendant stipulated to liability but contested the injuries and wage loss. Defendant's pre-trial offer was $145,000.00. After five days of Trial following Ms. Zeise's Closing Argument, the defense offered $1.5 million dollars.
