introduction
Albert has extensive experience in general civil litigation in federal and state courts. His current emphasis is in the area of commercial litigation, but he has handled a wide variety of civil matters in his three decades of practice. Albert also represents federal criminal defendants on a regular basis.
Representative legal matters include:
Obtained $7.4 million judgment against asset management firm in favor of charitable foundation after non-jury trial in New Jersey federal court.
Obtained $6.5 million judgment against three municipalities in favor of County Self-Insurance Workers Compensation Plan after jury trial in New York State Supreme Court.
Was appointed by the Court as lead counsel in federal drug conspiracy prosecution in the Northern District of New York against 82 defendants.
Was appointed as co-counsel in 1994 to represent defendant in death penalty prosecution in the Northern District of New York. The matter was tried to jury in 1995 and 1996, resulting in a conviction after approximately five months of trial. The defendant was spared the death penalty, however, when one juror held out against the other 11. The matter was only the third federal death penalty to be tried in New York State since the federal government adopted the death penalty in 1988.
His published legal decisions include:
United States v. Applins, 637 F.3d 59 (2nd Cir. 2011); Orezzoli v. Syvertsen, 1998 U.S. App. LEXIS 20638 (2nd Cir. 1998); W.R. Huff Asset Mgmt. Co, L.L.C. v. William Soroka 1989 Trust, 398 Fed.
