PRUETT V. U.S. BANK NAT'L ASS'N

Plaintiff: Attorney for the plaintiff, Franklin Monroe Pruett. The plaintiff entered into a residential contract of purchase and an addendum to standard purchase contract with the defendant, US Bank National Association. The property he agreed to purchase failed to close and Pruett filed a complaint against the defendant. The defendant's countered that the plaintiff had failed to state a claim and therefor the case should be dismissed. The court agreed and the case was dismissed without prejudice.

How did you build a successful practice?

Hard work, good choices, excellent staff, investment in significant staff training to ensure the best possible support, division of labor/delegation.

What should clients look for in a lawyer?

Responsiveness, honesty, integrity and the ability to communicate effectively. Availability to answer questions, or to have an office structure that ensures answers to the client's questions and responses to their needs immediately - or, at worst within 24 hours.

How important is local knowledge to the success of your cases?

Very. We operate in a small rural area in the Southwest Virginia region, serving the counties of Tazewell, Russell, Buchanan, Bland, Washington, and the City of Bristol. Name recognition and brand awareness is critical. Knowing our clients, culture, and the area is critical for delivery of services that meet the client's needs.

What information can you provide in a free phone consultation?

Our firm can do intakes via telephone in personal injury cases, workers' compensation, Social Security, Will preparation, Preparation of General Durable Powers of Attorney and medical directives, guardianship/conservatorship, deeds, real estate closing general information, and corporate entity development. A follow up meeting is necessary to conclude and endorse all documents, but our goal is to save the client time. We also offer SKYPE consultations and meetings - including Skype availability for real estate closings (brokers, realtors, any party who may be unable to appear personally).

What is the most rewarding aspect of your job?

Providing quality service that delivers results to clients who had serious concerns about the outcome of their case. Calming the client's fears and concerns and standing for those individuals as their voice and defender. Providing jobs for our staff here in Southwest Virginia.

What are your other interests in addition to law?

Music - I am guitar player in a local band. Motorcycles - I regularly ride dirt bikes with my son. Travel.

Are you involved in your community?

I serve on the board of directors of "Hungry No More" a nonprofit organization that ensures no school children go hungry at school by delivering financial assistance to Tazewell County schools. I am a member of Life Church at Richlands. I serve as Town Attorney for the Town of Richlands, Virginia. I am always looking for ways to enhance our community and economic development.
