About Bradley
Bradley M. Seldin was born in Teaneck, New Jersey and has lived in South Florida since 1998. Mr. Seldin earned his Bachelor of Science degree at Syracuse University's School of Management in 1995. He subsequently earned his Juris Doctor degree from Pace University in 1998. While attending law school, he was on the Dean's list during 1996 and clerked for a U.S. Bankruptcy Judge and a Chapter 7 Bankruptcy Trustee. Upon graduation from law school, he worked as a Staff Attorney/Legislative Aide to one of 40 Florida Senators from 1998 to 2000, working closely with various Senate Committees, Legislators, Lobbyists and private citizens to shepherd the passage of bills into law. After two years with the Florida Senate, Mr. Seldin joined a large South Florida firm and specialized in civil litigation, joining the Firm two years later as an associate.
At the Law Offices of Steven M. Ziegler, P.A., Mr. Seldin concentrates his practice in the representation of managed care organizations in medical malpractice matters, benefit disputes, and all other areas of managed care liability, as well as general liability insurance defense. To that end, he practices in both state and federal courts, including medical malpractice cases brought against managed care organizations based on a wide variety of liability theories, including vicarious liability, negligent credentialing, non-delegable duty and direct negligence for utilization management functions of case management and concurrent review. He handles member disputes over medical benefits, premiums, continuation of coverage pursuant to COBRA, conversion policies, and rescission actions. He has also represented health plans as both plaintiffs and defendants in collection matters. His practice also includes ERISA litigation, including health, life, accidental death and disability benefits, both short-term and long-term. He also represents insurance companies on non-ERISA employee benefits cases, as well as individual policies of health, life and disability insurance. Mr. Seldin negotiates and litigates subrogation liens for managed care clients when they have lien rights in personal injury cases.
Mr. Seldin also practices in litigation over residential and commercial leases. In that capacity, he has represented landlords and tenants in eviction cases. Mr. Seldin is also experienced in Bankruptcy Law, representing debtors in Chapter 7 and 13 cases. He has also represented creditors in Bankruptcy Court.
Notable results include his assistance with compelling arbitration in the matter of Sims v. Clarendon National Insurance Company, 336 F. Supp. 2d 1311 (S.D. Fla. 2004), where an insured brought breach of contract action against her health insurer after insurer denied coverage for cost of treating insured's leukemia. The insurer moved to compel arbitration, which was granted, as the court found the dispute was subject to compulsory arbitration under the Federal Arbitration Act.
Mr. Seldin is admitted to the Florida Bar, the District of Columbia Bar and the New York Bar and is a member of the Florida Bar Health Law Section. He is also admitted to the U.S. District Court for the Southern District of Florida and the U.S. District Court for the Middle District of Florida.
