At+K14:U26torney for the Defendant in a high profile case involving the kidnapping of three young women who said Defendant also held captive and tortured. Said attorney helped his client avoid the death penalty by negotiating a plea deal.
Appellee: Attorney for the plaintiff/appellee, Christopher Sample. The defendant/appellant, Jason Bailey, appealed the district court's denial for his motion to grant a summary judgment. He argued that he was entitled to qualified immunity with respect to Sample's fourth amendment claim of excessive force. The court found that a summary judgment was inappropriate because Sample alleged a violation of an established constitutional right. Upon review of the case the appeals court agreed with the decision of the district court. The judgment was affirmed and Bailey's appeal denied.
