Barbara Rogachefsky is an attorney representing clients in the areas of family law, juvenile law, criminal defense, and general litigation. Her areas of special interest are criminal and civil domestic violence. Barbara worked her way through law school as a court-appointed public defender. After law school, Barbara became a volunteer AmeriCorps attorney with the Appalachian Ohio Domestic Violence Project advocating for and representing indigent victims of domestic violence in four counties through the Southeastern Ohio Legal Services field office in New Philadelphia, Ohio. After her service with AmeriCorps, Barbara worked at a small boutique law firm in Sandusky, Ohio for four years before founding her own law firm in Cuyahoga Falls in 2003. Barbara was born and raised in Rochester, New York. She earned her Bachelor’s degree from Syracuse University in 1991 and her law degree from the University of Akron, School of Law in 1997. She was admitted to practice in Ohio in 1997, the United States District Court for the Southern District of Ohio in 1998 and the Northern District of Ohio in 2002. She is a member of the Ohio State and Akron Bar Associations, Phi Alpha Delta (National Law Fraternity) and Area Director for International Referral Network. She has been a member of the Cuyahoga Falls Chamber of Commerce since 2004. Barbara also volunteers at the Volunteer Legal Services Program. She is a past member of the Erie County Family Law Committee, Ohio State Legal Services Statewide Family Law Task Force, the Holmes County Domestic Violence and Sexual Assault Task Force, Holmes County Community Resource Council, and the Past President of the University of Akron’s Law Association for Women.

Throughout my 35 plus years of practice, I have represented individuals in all aspects of employment law in order to protect their jobs and families from the arbitrary actions of management who often view their employees as disposable. I have been proud to represent victims of discrimination of all types and effectively prosecuted their claims in either federal or state court. More recently my firm has advocated for an employee who has been harassed on the basis of their sex, age, or race. We have discovered that simply because an employer may have a procedure for reporting such harassment does not mean that the employee is protected or that the claims are fully investigated. It is surprising that even today many companies try to cheat their employees out of the proper earnings through a variety of illegal activities. Some of the more obvious are forcing their workers to work off the clock, either before or after their shift, failing to pay overtime for all hours worked in excess of 40 hours per week, or telling you that you are an independent contractor when you have no control over your work hours. All of these actions violate the Fair Labor Standards Act which has been enforced since the 1930s. If you are classified as an independent contractor, not only does the company avoid withholding taxes, they also don’t pay their portion of social security and unemployment taxes that could affect you as you near retirement.
