About Daniel

Dan Ackman focuses on civil rights, administrative and constitutional class action litigation. Perhaps best known for representing New York City’s taxi drivers in a series of civil rights class action lawsuits, Ackman’s cases have resulted in five City practices being declared unconstitutional or illegal. He has also recovered millions of dollars in damages for taxi drivers whose licenses have been suspended or revoked. And he may be the only lawyer in America who has deposed both former NYC Mayor Rudy Giuliani and current President of the United States  Donald Trump.

Dan has also handled commercial cases for small business owners and large financial institutions as well as on behalf of taxi drivers who alleged taxi fleet managers had overcharged them. He has won more than $3 million in judgments in commercial actions.

He is currently co-counsel in two actions on behalf of taxi drivers and investors who purchased medallions from the City of New York at auctions just before the TLC opened the door to e-hail taxis, which decimated the value of the medallions the City had just sold.

Early in his career, Dan was associated with Skadden Arps Slate Meagher & Flom, where he specialized in securities, real estate, and commercial litigation. Later, he was the lead writer in a treatise on securities litigation.

A native New Yorker, Dan is a graduate of Wesleyan University and the Columbia University School of Law, where he was a Harlan Fiske Stone Scholar, a teaching assistant, and an editor of the Journal of Law and Social Problems.

Dan is a member of the bar of the State of New York, the Second Circuit Court of Appeals, and the United States Supreme Court and has been profiled in The American Lawyer and in The New York Times.

Questions & Answers

Please describe a case in the last year or two where you made a big difference.

In Nnebe v. Daus, I won an appeal decision that held that City of New York's practice of suspending taxi drivers based on an arrest was unconstitutional. The Second Circuit Court of Appeals held that the post-suspension hearing that the City afforded drivers was a sham and that denied drivers due process of law. This decision impacts more than 20,000 taxi driver over the last 17 years.

How did you build a successful practice?

My practice is based mostly on class action litigation that challenges the constitutionality or legality of government programs. My cases have resulted in at least six government programs being held at least in part in violation of the United States Constitution. I am also experienced in commercial litigation between individuals or corporations.

What should clients look for in a lawyer?

Intelligence, toughness, preparation and courage.

What information can you provide in a free phone consultation?

I can often make a fairly quick assessment about whether your grievance, injury or problem can amount to a successful legal claim.

What information do you need in a free phone consultation?

I mainly need the facts of what happened and when it happened. I can take it from there.

What differentiates you from other lawyers in your community?

Very few lawyers have had my level of success in constitutional litigation and most do not have the tenacity to take on cases that could last years.

What are your other interests in addition to law?

Hiking, cycling, kayaking, my dog Koufax and my family.

Are you involved in your community?

I have served on my community board and am currently the trustee of a charter school.
