David W. Kesselman is a partner with Kesselman Brantly Stockinger LLP. Mr. Kesselman has represented plaintiffs and defendants in complex litigation matters including: antitrust, unfair competition, business torts, copyright, class action, wrongful termination and professional malpractice cases. Mr. Kesselman has experience in all facets of civil litigation, including examination of lay and expert witnesses at trial, arguing dispositive motions (including summary judgment) and taking and defending depositions in state and federal litigation matters. His appellate experience includes drafting briefs filed in the Ninth Circuit Court of Appeals, the California Court of Appeal, and the California Supreme Court, including the seminal case of Korea Supply Co. v. Lockheed Martin, Corp., 29 Cal. App 4th 1134 (2003). He has been selected as a "Rising Star" in the 2005, 2006, 2007, 2008 and 2009 editions of Southern California Super Lawyers Rising Stars magazine.

Significant Matters:

  • Represented a U.S. based company against a large multinational conglomerate in a business interference lawsuit involving military procurement contracts in the Republic of Korea.
  • Defended a national motion picture theater chain against alleged antitrust claims brought by a competitor motion picture theater. 
  • Represented three separate classes of music composers and owners of sound recordings against major television studios and distributors for failure to pay licensing fees in violation of federal Copyright Law.
  • Represented a company in a professional malpractice suit arising out of an antitrust case.
  • Represented an individual in a wrongful termination against a multinational conglomerate.
  • Represented a U.S.-based company against a company based in the Federal Republic of Germany for breach of contract and business torts.
  • Defended a transportation company in an alleged below cost pricing lawsuit brought by a smaller competitor.
