About David

David M. Stegall is a shareholder at Lawton & Cates who was admitted to the Wisconsin Bar in 2006 after graduating cum laude from Marquette University Law School. David began his legal career by working as an Assistant District Attorney in Milwaukee County. In his role as a prosecutor, David litigated hundreds of cases and served as the lead prosecutor in well over 40 jury trials ranging from minor misdemeanors through the most serious felony cases.

David left the District Attorney’s office so he could focus on helping people achieve justice. In private practice, David focuses 100% on litigation. Put simply, David’s clients seek him out to represent and defend them when the stakes are the highest. In David’s criminal practice he has successfully obtained not guilty verdicts in high stakes cases ranging from Attempted First Degree Intentional Homicide, First Degree Sexual Assault, and Possession of Child Pornography among others.

In David’s civil practice, he focuses on being a zealous advocate for the rights of the injured. David has represented many injured people including victims of car accidents, dog bites, and work-related injuries. David has consistently achieved great results from his clients, including at trial. Prior to attending law school, David served in the United States Army as a Cavalry Officer stationed at various posts throughout the United States. David is a passionate supporter of our military veterans and proudly serves on the Veteran’s Advisory Board. Please describe a case in the last year or two where you made a big difference.

Here are two examples. Criminal sexual assault cases can be some of the most difficult to defend against for a variety of reasons. In this case, the State charged my client with three counts of 1st Degree Sexual Assault. The allegation was that my client sexually assaulted another person nearly a decade prior. My client adamantly maintained his innocence. Given the age of the allegations we had somewhat limited defense options because the client could not remember with certainty where he was on a certain date over a decade prior. Nonetheless through hard work and exhaustive pretrial preparation, we were able to obtain not guilty verdicts on all counts. This case also demonstrates the importance of good trial preparation. My client was involved in a rear-end car accident. As is often the case, the insurance company argued that the client's back injury was not caused by the accident. The insurance company hired a doctor to advance this argument for them. At trial, Attorney Stegall impeached the insurance company doctor with documents indicating his medical license had been revoked in other states. At the end of his cross examination, the insurance company surrendered and agreed to pay the client more than $165,000, which was a 750% increase over what the insurance company offered to settle the case before trial.

How did you build a successful practice?

First, I am fortunate to be part of a great law firm that has been helping people for over 60 years. Being able tap into that collective wealth of experience has been invaluable and helps me achieve great results for my clients. Second, to the extent I am considered a successful lawyer it is because I believe I am always focusing on my client's needs and doing everything that I can to help him/her obtain the best possible outcome.

What should clients look for in a lawyer?

In my opinion, you should look to retain a lawyer for your case that you believe is competent and communicates well with you. You can, and should, research potential attorneys online to learn more about their experiences and current practice areas. Positive signs for an attorney include a list of prior successful results and positive reviews from former clients. Attorneys that offer a free initial consultation is a good way to start so you can get a better feel for the attorney's knowledge, experience, and personality.

How important is local knowledge to the success of your cases?

It can be very important depending on the case. Sometimes knowing the players/personalities involved is as, if not more important, than the specific facts and circumstances of a particular case.

What information can you provide in a free phone consultation?

I offer no cost, no obligation consultations so I can learn more about your specific legal needs and offer some recommendations on how to proceed. Often times, legal matters are complex and do not lend themselves well to simple, online case submissions. In my experience, a free phone consultation is a good way for the attorney to learn more about your situation and for you to learn more about the attorney's services.

What information do you need in a free phone consultation?

There are no hard and fast rules as it depends on the specifics of your case. However, if you have been served court documents, or documents from the police or an insurance company, those are typically important to have with you during the call.

What differentiates you from other lawyers in your community?

I recognize that in your search for legal assistance, it can seem as if there are almost an infinite number of lawyers. I believe the vast majority of lawyers that you will encounter will be competent. The vast majority are ethical. The vast majority of lawyers will be reasonably to very knowledgeable. I have come to know most of the other quality lawyers throughout Wisconsin. Almost to a person, they are each very nice and thoughtful. They are well intended experts. Their expertise is worthwhile.Those lawyers approach working with a client like you, disseminating their expertise, in a very tactical, clinical, one off way. They are your lawyer only for as long as your case is active. Once your case is done, they are moving on to the next client, and the next one, so on. If that is what you want you should interview those attorneys. I play a totally different game. I strive to become your trusted legal advisor for life. I give you the recommendations that I think are in your best interest. I do not charge you more than your case demands and I do not charge you less. I explain my rationale for why I believe you should take certain actions. I give you perspectives that I believe are insightful and strategically more meaningful.
