I am principally a commercial litigator and have successfully represented numerous businesses and individuals in all phases of commercial litigation and arbitration in both California and Arizona, with the majority of my experience derived from defending and advising small and medium-sized businesses in product-liability, breach-of-contract, and warranty disputes, and with respect to labor and employment matters, including wage claims and unfair-labor-practice proceedings before the National Labor Relations Board and the 9th Circuit Court of Appeals. I also routinely advise clients with respect to business formation, purchase, and management. Rash v. Town of. Mammoth, 233 Ariz. 577, 315 P.3d 1234 (App. 2013).

HOLDINGS: [1]-It was an abuse of discretion to dismiss an officer's Ariz. Rev. Stat. § 38-1004 special action contesting his firing by applying the Ariz. R. Civ. App. P. 9(a) 30-day time limit through Ariz. R.P. Spec. Actions 7(i) because Ariz. R.P. Spec. Actions 7 did not apply; [2]-Ariz. Rev. Stat. § 12-904(A) did not require dismissal because it did not apply to decisions of appellee town or appellee county employee merit system commission (Commission), Ariz. Rev. Stat. § 38-1004 provided a definite judicial review procedure, and Ariz. Rev. Stat. § 12-901 et seq., did not apply to special actions under Ariz. Rev. Stat. § 38-1004(A); [3]-A dismissal under laches was an abuse of discretion because no unreasonable delay was found and nothing showed prejudice; [4]-Ariz. Rev. Stat. § 38-1004 provided subject matter jurisdiction because the officer clearly contested the Commission's acts.
