  • $30,000,000 SETTLEMENT

    In a series of several cases, temporary staffing employees alleged that their staffing agencies maintained vacation policies that denied them the right to earn and accrue vacation time as they worked.

    As a result, the employees claimed that in violation of an Illinois law, the Illinois Wage Payment and Collection Act, they were not paid all of their owed vacation pay as part of their final wages. After significant litigation, these cases settled in what are believed to be among the largest employment class actions in Illinois history.

    $12,300,000 SETTLEMENT

    Inside staffing recruiters for a national healthcare company sued their employer claiming that they were misclassified as exempt from federal and state overtime laws. They claimed that because of their job duties, they were not properly considered exempt from overtime under either the executive employee or administrative employee exemptions. After winning conditional certification of the federal Fair Labor Standards Act claims on behalf of staffing recruiters employed by the company throughout the United States, the case settled for $12,300,000.

    $12,000,000 SETTLEMENT

    Employees working as “Client Associates” for a well-known national financial service sued for not being paid overtime for all the hours they worked in excess of forty hours per week. The employees alleged that their employer violated the Fair Labor Standards Act and the California, New York, Washington and Maryland state wage and hour laws related to overtime pay. Among other things, the employees alleged that they and other employees were paid overtime based on an incorrect and low regular rate of pay; that Defendants failed to properly record and account for all overtime hours worked, gave them incomplete and inaccurate work and payroll records; that with regard to persons employed in California, failed to furnish accurate wage statements and failed to provide meal and rest periods; and that with regard to New York employees, failed to pay spread of hours compensation. The case settled for $12,000,000.
