Escobar v. Harris County, Court of Appeals (Houston) 1st District 2014

Following an attempted traffic stop, Luis Manuel Escobar fled in his car from a Harris County Sheriff's Deputy. At the end of the pursuit, Luis was shot and killed as he ran from the scene. This lawsuit was brought by Luis's mother, alleging that her son's death resulted from the unlawfully excessive use of force by the Harris County Deputy for wrongful death and for violation of 42 U.S.C. § 1983. Both defendants moved for summary judgment. The trial court granted summary judgment on all claims. On appeal, the appeals court decided that the evidence presented genuine issues of material fact as to whether the Deputy used unconstitutionally excessive force and whether his actions were shielded by qualified immunity, and the case was reversed.
