Eric A. Rosen practices law in the areas of bankruptcy and creditors’ rights, out of court debt restructuring, business litigation and commercial law.

Eric has represented public companies, closely held corporations and individuals as debtors and debtors in possession in bankruptcy cases since 1986. These cases have involved debt ranging from less than $100,000 to more than $100,000,000. He also regularly represents secured and unsecured creditors in cases under Chapters 11, 7 and 13 of the Bankruptcy Code. He has substantial experience representing lenders providing post petition financing to debtors-in-possession, factors who lend against accounts receivable of debtors in possession, and holders and purchasers of distressed real estate mortgages. He has served as counsel to petitioning creditors in contested involuntary bankruptcy cases, official creditors’ committees and members thereof in chapter 11 cases, and court-appointed trustees. He has participated in a number of well known cases, including R.H. Macy & Company, Inc., In re Drexel Burnham Lambert, Inc., In re Super Glue and The New York Post. He represents debtors and creditors in out of court workouts, and Assignment for the Benefit of Creditors cases in state court.

Eric has been lead counsel in a broad spectrum of business litigation matters. He has won a substantial number of cases on behalf of plaintiffs and defendants, ranging from small arbitration proceedings, to bench trials and appeals in state court, to multi-week jury trials in federal court involving more than $35,000,000.

A member of The Florida Bar (Business Law Section), and the Palm Beach County Bar Association (he is a member of the Board of Directors of the North County Section and a member of the Bankruptcy CLE Committee), Eric is also a member of the Board of Directors of the Bankruptcy Bar Association of the Southern District of Florida. He regularly lectures on bankruptcy, insolvency and litigation-related issues.

We realize that the cost of quality legal representation can be a significant concern. We know that all clients, regardless of their financial wherewithal, need to believe they are being treated fairly and that their fees are reasonable. We also know that not all clients may currently be in a position to pay attorneys at the rates and in the manner traditionally utilized by law firms. While we generally bill on an hourly basis, we are sensitive to the needs of certain clients to depart from the traditional practice of hourly billing. Depending on the particular circumstances of a given case or transaction, we are willing to consider a number of billing alternatives. Such alternative billing arrangements may include the following: Combined hourly/contingent fee arrangements — where both the hourly rate and percentage of recovery are reduced Flat fee arrangements for an entire matter (other than those matters for which a flat fee is traditionally paid) Monthly flat fee retention rates "Blended" hourly fee arrangements — where one hourly rate is charged regardless of the lawyer who works on the case, as opposed to different rates for different attorneys in the firm Flat fee arrangements for a specific aspect of a particular case or transaction Annual flat fee arrangements, and so forth. We are committed to providing clients with the highest quality service possible. An integral part of this commitment is our willingness to explore any form of reasonable alternative billing arrangement. We encourage all potential clients to work with us in designing an equitable alternative billing practice that meets the client's needs and is practical in view of their case or transaction.
