I hired Lauren Stuckert in early 2018 for a case that ultimately dragged on for five years due to a variety of factors including Covid. Lauren was reassuring and professional every step of the way. I owe a great debt of thanks to Andrew Mishlove. He successfully defended me in an OWI case that endured for more than 6 ½ years in the Wisconsin judicial system, including a detour through the Wisconsin State Supreme Court system, and ultimately led to a showdown in an Ozaukee County criminal court resulting in a not-guilty verdict returned by a 12-member jury in February 2023. I think my experience qualifies me to personally attest to Andrew Mishlove’s reputation as a brilliant trial attorney and one of the best OWI defense lawyers in the entire country. This is my story. I was very fortunate to have been indirectly referred to Andrew Mishlove by no less than two Milwaukee County judges via a long-time family friend. We had sought referrals for the very best OWI “trial” attorneys in Wisconsin. We knew we needed a top-notch courtroom fighter that would not back down in the onslaught of a high-pressure trial. I was just plain lucky that Milwaukee had one of the best OWI attorneys in the country with Andrew Mishlove. Prior to meeting with Andrew for the first time, I had briefly paid for the services of three other well-known attorneys to review my case. Andrew was the only attorney among them that flagged a glaring judicial irregularity in an 11-year-old prior case which led us to a successful appeal in Ozaukee County, but fell short by narrowest of margins in the Wisconsin state supreme court. I never would have imagined that a global pandemic, court delays, motions and endless proceedings would extend my case for years more. But I can say that Andrew never lost his motivation, energy, inquisitiveness or intellect. It all ultimately resolved down to an intense and brutal, two-day trial that unfolded in an Ozaukee County courtroom where I was truly grateful for Andrew’s skill and expertise in revealing the flawed biological controls and testing standards employed by state testing laboratories in OWI cases potentially across the country. I watch in amazement as Andrew went head-to-head with a dogged, well prepared and very well-read prosecutor (with the resources of the entire state) in a courtroom battle of wits, arguments, solid research and pervasive interpretations of over a dozen technical research articles that spanned across the scientific fields of biology, chemistry, and forensics, while delving into diverse topics such as cell division, fermentation, metabolism, spoilage, preservation additives and scientific methods of analysis. I was surprised by the prosecutor’s tenacity and the lengths that the state will go to convict a suspect with a “take-no-prisoners” approach to OWI offenses. Andrew had not only a superior grasp of scientific knowledge, but he has the critical ability to capture and distill it all down into comprehensible arguments that were understandable and convincing to a jury. Andrew’s closing argument was a masterful articulation of the relevant facts, technical research, expert witness testimony and common sense. Andrew was very quick in adapting and responding to the prosecutors closing arguments and prosecution efforts to convict at all costs. But it was Andrew’s incredible tactics that turned the prosecutors’ own arguments against him that proved entirely compelling and convincing to a jury. The more the prosecutor doubled-down on his arguments, the more Andrew dug in and made counter arguments. When the prosecutor cited research while omitting crucial details such as “refrigeration affects upon blood sample integrity”, Andrew flagged the details and corrected the prosecutors “distortion-by-omission” attempts. Andrew is an expert in OWI defense. He is incredibly well informed and prepared before a trial. He is approachable, a professional, and serious. Finally, Andrew was always a gentleman in and out of court. He was well liked by the judges, the prosecutor and most importantly, the jury. His courtroom demeaner and ethics were unflappable. At the beginning of my experience I interviewed several attorneys. Each had a different fee schedule and approach. Sara was very kind and helpful on the phone. She then scheduled a zoom call with Andrew. When Andrew called he was very caring and enjoyable to talk to. He asked many things about me and took the time to get to know me. We then discussed how he could help, and he gave me no nonsense straight forward answers. He explained he wasn't the cheapest and what he could do for what cost. In the end everything they told me was honest, and the outcomes happened as they predicted and coached me on. Their guidance through my issue was exceptional. These people are class acts. I highly recommend Mishlove & Stuckert. I was charged with an OWI in 2019 and due to a backup in the court system, just had my day in court a couple of weeks ago. During the time leading up to my trial, Andrew Mishlove proved to be a fantastic advocate and really seeked to understand the incident and the story behind it. After our preparation, Andrew was able to represent me extremely well in court through compelling presentation of facts and storytelling that provided much needed context for the jury. He is an absolute expert in Field Sobriety testing, so Andrew was able to leverage that knowledge to show the ones performed on me were wrongly administered. Moreover, he was able to ask witnesses strong questions and used their answers to further craft a narrative. He was also a great listener to the prosecution so he was able to address concerns and reservations the jury may have had. Andrew also leveraged his great know-how in court to present himself as credible and trustworthy - both things that he really is. Through my entire trial, I felt confident that I had the best representation out there. With Andrew's assistance, I was found not guilty. We were reluctant to hire Mr Mishlove due to his high fee, however, looking back, it was one of the best decisions we have made. 1st OWI reduced to reckless driving.
