Review Lloyd Winter Law Firm I am a disabled owner in the common interest development located in Fremont California known as Meadow Brook Village. I filed a lawsuit for emotional distress and breach of fiduciary duty against the HOA Board and the property management firm. The lawsuit proceedings jurisdiction and venue Alameda County Superior Court Case No. HG18897381, Bernstein vs. Associa, et al. We, the homeowners were denied pool facilities, have suffered emotional distress due to breach of fiduciary duty at the hand of defendants. I retained Lloyd Winter to represent me in complex motion for summary judgment opposition. HOA corruption is rampant throughout the U.S. We, as homeowners at MeadowBrook have had nearly $100,000.00 levied against despite never missing payments due to neglect, mismanagement by HOA Board members. In Surfside, Florida, Chamberlain Towers 100+ people actually lost their physical lives in 2021 due to neglect of repairs; Meadowbrook here financial lives and physical health affected. In a common interest development also known as a condominium association owners pay monthly assessments as well as their mortgage. These assessments are used for operating costs as well as a portion set aside in accounts by law for future repairs and needs. When the developers initially set up the condominiums the developer’s representatives function as the Board of Directors. Once enough of the units are sold it is then turned over to the homeowners to elect a board. Although volunteers the homeowners have chosen this responsibility, voted in and have a fiduciary duty to the other homeowners. Jennie Panicker and Sean Fredin, extremely competent attorneys for the law firm, have done an outstanding job for me. All of the law firm is extremely caring and personable. I will retain them again during this matter if I can afford to and have the opportunity ideally before the jury trial before my peers in 2023 and during the jury trial.
