Robin Williams December 2021, Landon was hired out of concern unforeseen forces -- flight delays and/or cancellations -- would prevent me from attending what should have been the conclusion to my probation obligation(s) to the 20th Judicial Collier County court. Simple...so I thought. Now, I am being ordered to appear in court March 2022 to explain (??) the diagnostic findings/treatment recommendations of an accredited substance and mental health assessment agency (New Direction). An agency that provides evaluation report services for over 15 years to 48 states and over 750 counties. Assessment Findings: 1) Substance Abuse Use - "suspected substance use condition not found" (court mandated) 2) Mental Health Findings - anxiety and depression associated with bipolar disorder (not court mandated) Simple...to be continued. I'll let you know if hiring Landon was a wise investment after my March 2022 court appearance. Today, I write to give light to the truth of my current disappointment. 03/29/2022 @ 10 am my assigned time to appear before Judge M. Brown. ”A lawyer has ethical obligations to the client and the court, which include the duty of loyalty to the client, to not intentionally hurt the client, and a duty of candor to the court.” $375 x 2 = $750 total for two substance use assessments; both diagnosis "suspected substance abuse not found" no recommendations. The 1st assessment was submitted to the court, the 2nd assessment was retracted at the request of the assessor (Resolve It Now (RIN)! Drug and Alcohol Assessments), according to Mr. Miller. This "new" information was conveyed to me by Mr. Miller 15 minutes before my court appearance. After my hearing, I disputed the $375 charge for the 2nd assessment for services not rendered and demanded a refund. The assessor's emailed response to my refund demand: "I never spoke to your attorney, and I did not retract report." Mr. Miller LIED. Mr. Miller must be held accountable for his decision to: 1. Withhold information relevant to a case without consultation and 2. Violating the fiduciary relationship with his client. I WANT A REFUND! Would the 2nd assessment have change things, we'll never know and it doesn't matter. Actions have repercussions, I own mine...what I did was wrong. My dispute with F.S. 316.193 is its exclusivity of mental health assessments and treatment as an acceptable alternative to a court mandated special condition if substance abuse is unfounded. (Note: My purpose is to inform, warn and prevent.) Thank you
