Mark Fusco is very unprofessional and not polite. Whether a good attorney or not he has a lot to learn about being professional, treating people with respect and being humble. Kind of understand why this firms reviews are so low with Mr. Fusco as the Chair. Do better, you owe it to your firm and your profession!
They later filed two motions to the IHO asking the IHO to issue order to refrain me from making any constantly email communications, disregarding the fact I was making constantly email communications was mainly due to their constant motions and emails, and also due to I am a Pro Se Parent, all alone to prepare for the case and need to secure the right I was entitled to under IDEA. They also requested the IHO to issue order to announce I filed expedited hearing was for improper purpose and without factual ground. Both requests were denied by the IHO. They also constantly sent harassing motions, emails, PR01 notices to request me, the pro se parent to list and to clarify what specific rights my child was denied for what specific reasons…. I was even puzzled… Why? Because my due process file was as long as like 130,000 words, and organized in both chronological and factual claims section orders….Due to several issues occurred after I filed the initial due process, I slightly revised the file and resubmitted an amended one by clearly listing the reasons and summarizing what part I have revised, although I am not required to. But I wrote in my email, for the sake of saving both IHO and the district attorneys’ time, I am summarizing here for you both. Not only that, I probably have clarified like more than 5 times there were no change at all in the main factual claims part, but just the last resolution proposal part and even for that slight change, I have already summarized directly for the district attorney Ms.P and Ms. W. Besides that, each of my response to their motions, emails were always as thorough and detail as possible, at least thousands of words. Nevertheless, I was kept been haunted and harassed by their constant requests providing more details and specifics.
BTW, when I filed my initial due process file, I also forwarded 34 attachments as a support of my case, so to sum it up, both Ms. P and Ms. W have had more than necessary in the very initial stage than any of the cases they have ever handled, I am very sure about it. After being haunted and harassed for numerous times while I was struggling to maintain a balance among several roles: being a full-time worker, a mother of two little girls, a pro se parent to advocate for her special needed child, and a non-native speaker, I asked myself what I have done wrong to deserve such an treatment? The answer is No, I did nothing wrong except for advocate for my poor little girl. They requested the IHO to issue order to find that my expedited motion was filed for improper purpose, but she forgot she filed time extension for 50 days first. If my expedited hearing request was for improper purpose, then what made her to think her 50-day time extension was filed for proper purpose? Thank goodness Ms. P and Ms. W are just two attorneys, not a judge or IHO, their act made them look like they are dictators…So they are fine to file what motions they want, but if the pro se parents filed any motions, like requesting “educational records” “Public hearing”, “Child’s attendance”, “ Public records” will then be labeled as “ a flurry of motions” by them. I am a non-native speaker, I do not have a sea pool of beautiful wording to embellish my claims or modify my wording to make it more officially appealing to the public, but I firmly believe the most simple but plain language will tell the truth, nothing but only the truth. I have already filed a complaint letter to OSBA, it’s up to them whether or not to initiate a further investigation against these two attorneys, I am not seeking any legal advice or expect any disciplinary action will occur…but merely to bring their conducts to the authoritative body’s attention and great public’s awareness per my own true real-life experience…. So, shop around before you sign a contract with Ms. P and Ms. W., or get prepared for their tricks if you are opponents. 7/15/2021
All i did was make a call to them. My job was screwing me over coronavirus. These attorneys jumped on it. No hesitations. Very good feeling to know there are competent ,fair, and caring attorneys iutthere to help in times of need.
Had a terrible experience settling my fathers estate which they handled. Zero communication and acted like they were doing a favor. Would not recommend when so many other choices.
