David Freishtat is the founding partner of the Maryland law firms Freishtat & Sandler and Freishtat & Mullen, LLC. A graduate of the University of Maryland School of Law in 1961, Mr. Freishtat has an AV Martindale Hubbell Rating and has been actively engaged in complex business litigation of every variety in state and federal courts for the last 41 years. He is the co-author of "Pattern Examinations of Witnesses for the Maryland Lawyer". Please describe a case in the last year or two where you made a big difference.

The firm recently concluded litigation which was twice argued in the Court of Appeals (Maryland's highest appellate court), in which we represented twenty-five condominium owners in a lawsuit against their condominium association and its property management company arising out of alleged misleading statements and alleged material non-disclosures made to the plaintiffs prior to their purchases of condominium units regarding the condition of the condominiums, required repairs, as well as the financial cost associated with their purchases. After the Court of Appeals issued a landmark decision with regard to the Maryland Consumer Protection Act and applied it to the sale of condominiums in Maryland, which was a previously open issue, we settled the litigation successfully on behalf of our clients. See MRA Property Management v. Armstrong et al. 426 Md. 834, 43 A.3d 397 (2012).

The client should look for a lawyer who listens carefully, has extensive experience in the area of law the client needs help in resolving, who has high ethical standards and who gives the client straight forward advice about the pros and cons of the matter, costs and possible outcome and who is not hesitant to make sure the client knows the risks inherent in any litigation and does not sugar coat the advice given.

What information can you provide in a free phone consultation?

In the initial phone call we can usually determine whether the matter is something that fits our practice, whether the person would be better served by seeking a different attorney or pursuing another course of conduct such as consulting with a state agency, attorney general or federal agency. We can also usually determine whether the economics justify a further discussion and/or a review of various documents. If the matter warrants further review, it is our normal practice to ask to see key documents and review them, at no charge, to make a more informed decision whether we may be of assistance.
