About Gary

Upon graduation from Rutgers Law School in 1979, where he competed on the Rutgers Moot Court Team, Gary C. Chiumento served as Law Secretary to the Hon. Merritt Lane, Jr. of the New Jersey Superior Court, Appellate Division. In 1983, Mr. Chiumento joined the law firm now known as Harvey Pennington, p.c., where he rose to the position of managing owner. In 2007, he formed Chiumento McNally LLC. Gary has achieved the Martindale Hubbell’s Preeminent AV rating and in 2019 has been recognized as a “SuperLawyer” in the field of Construction Law for the 10th consecutive year. Mr. Chiumento, a frequent speaker on issues within the design and business community, is co-author of the book Construction Administration for Architects (McGraw Hill 2009). Additionally, Mr. Chiumento’s writings have been published in the Marquis Messenger, AIA Practice Digest, and New Jersey Lawyer magazine.

Please describe a case in the last year or two where you made a big difference.

We tried a condo case for an architect where the damages were almost 20 million dollars The case was a "loser" as the architect all but conceded it was at fault. We tried the case for 2 months and the jury returned a verdict for less than 2% of the amount requested. We made the difference by not giving in to an unfair demand and preparing a good trial defense with a great expert and excellent preparation of our witnesses. In a previous case we represented a young woman who died shortly after an auto accident. We settled the case for almost 3 million thereby saving the family the heartbreak of trying the matter and reliving the tragedy all over again. The difference was our preparation, our expert selection and our decision to use mediation to resolve the case without a traumatizing trial. The difference between trying the first case and settling the second was our experience and problem solving skills once we understood our clients' needs.

How did you build a successful practice?

Our practice was built one client at a time through personal relationships with clients who faced a personal or business crisis We repaid their trust in us with tireless effort on their behalf

What should clients look for in a lawyer?

They should seek honest and prudent advice, timely and bold action and fair pricing of legal services

How important is local knowledge to the success of your cases?

Local knowledge of the people, the culture, the geography and the politics is invaluable in representing people in a given setting. We have offices in the major cities of each of the states and regions where we are admitted to practice. We are their often and understand the places where we practice law and try cases.

What information can you provide in a free phone consultation?

The free consultation is to gather information and make a preliminary assessment of the client's ability to obtain legal relief from a court. Whether the client is retained or not, the lawyer owes the client some legal "first aid" (what should I do now to preserve my rights?) and the time frame to seek relief (assessment of applicable statutes of limitations)

What information do you need in a free phone consultation?

Basically the lawyer wants to know the who, what, when, where, why ( and sometimes how) of the situation. The client should be prepared to discuss the basic facts and how they think they've been harmed. Come with plenty of questions.

What differentiates you from other lawyers in your community?

Our firm has bona fide litigators with business backgrounds. They can assess both the claim and the defenses. They can determine the clients need as well as the case value and focus on the client's goal. If the other side can't be persuaded to do the right thing, then we are prepared to vindicate the client rights at trial.

What is the most rewarding aspect of your job?

The most rewarding aspect of my job is using the law to help people achieve their goals. I may not be able to build a bridge, play professional sports, practice a profession or run a business but we can help those that do and we can help the average person achieve their goals as well. If that isn't rewarding then I don't know what is.

What are your other interests in addition to law?

I love movies , books, music, being with my family and friends. The pandemic has been hard on us, just like others, for that reason. But we will get through it.

Are you involved in your community?

I teach courses such as law for the lay person, i work with young people ( coaching, scout leader) and work as a volunteer for my condo board. I have also served as a District Ethics Board member which polices lawyer misconduct. This work is great and let's me give back to my community.
