Please describe a case in the last year or two where you made a big difference.
Several years ago, I was contacted and asked to collect a judgment of over $300,000.00 which the client had obtained in a collection action. It looked, at the time of the judgment that the judgment debtor was judgment proof so the file was placed on inactive status and scheduled for follow up review. After several reviews, it appeared the judgment debtor's financial condition had not improved. Rather than close the file as uncollected, I continued to review the judgment debtor's condition over several years. Then I discovered that the judgment debtor had obtained a job with a very handsome compensation. Despite claims by the judgment debtor of poverty, I was able by garnishment to collect the full judgment including accruing interest in a little less than two years. This made a big difference to the client who thought they would have to take a loss on this one.
How did you build a successful practice?
Important to my success has been the practice of keeping client informed on at least on a monthly basis of the progress of their cases and responding to their inquiries promptly. I believe client appreciate a personal approach to problem solving and desire to be informed and involved.
What should clients look for in a lawyer?
My web site www.provoattorney.net states "No meaningless slogan. No empty promises. Just straight talk, personal service and professional representation." Catchy slogans are cute but the bottom line and what I believe clients are really looking for in an attorney is just that, straight talk, personal service, and professional representation.
How important is local knowledge to the success of your cases?
Knowledge of the law, both substantive and procedural, is essential to fair and successful outcomes for clients. I have had broad experience for over 36 years in the practice of law. I have been a small claims judge for over 33 years. When I was first appointed a small claims judge the subject matter jurisdiction of small claims courts in Utah was $200.00. The jurisdictional limit is now $10,000.00.
What information can you provide in a free phone consultation?
My office provides free initial phone and office consultations. Quit often a matter can be resolved in the initial consultation; however, in other cases, hiring an attorney is necessary and advisable to resolve a matter.
What information do you need in a free phone consultation?
What information is needed in a phone or office consultation varies from case to case and there is no simple answer to this question.
What differentiates you from other lawyers in your community?
The thing that differentiates me from other attorneys probably is my experience and my desire to keep clients informed and involved in their cases.
What is the most rewarding aspect of your job?
The most rewarding aspect of my job is the satisfaction that comes from tackling challenging problems and working together with my clients to find suitable resolutions. I have enjoyed standing up for the rights of clients amid the chaos they can sometimes create in their lives.
What are your other interests in addition to law?
I am a huge BYU sports fan. I particularly enjoy football, basketball, and volleyball.
Are you involved in your community?
I have served on the Board of Trustees of the Family Support & Treatment Center, a United Way sponsored non-profit, for over 25 years. I am active in my Church. I am a Utah State Bar examiner and I serve as a member of the Utah Supreme Court Advisory Committee on the Rules of Professional Conduct.
