Attorney for a mason who was injured after falling from a 20-foot retaining wall while working at Package Pavement. Said Plaintiff sued the company claiming labor law violations, in failing to provide him with protective equipment while he worked at a height, claiming that Package Pavement was aware of the danger. Plaintiff received a 2.5 million dollar settlement.
Appellant: Attorney for the appellant, Aleksander Smolik. Smolik was allegedly injured while working at a New Jersey construction site. He filed suit against Turner Construction Company. Attorney's for the defendants moved to have the complaint dismissed on the grounds of forum non convenient. The Supreme Court granted the motions. Smolik subsequently appealed this decision. Upon review of the case and the legal statutes that the decision was based upon, the appeals court finds no err committed by the supreme court. The judgement was affirmed and costs incurred from the appeal are passed to the appellant.
